It is clear is that this trend will only grow. Just today a judge reprimanded the government for its NYT's subpoena request, forcing the govt to withdraw it, the admin withdrew its subpoena demanding a list of Penn's Jewish faculty and then lost another voter roll case, this time in Kentucky. /5

And we don't even know the full scale of it all. In most cases, we only know if the targets publicly announce the government's inquiry (and/ sue) or if subpoenaed companies tell the targets about the inquiry (and they then sue). /4

That is no longer the case. In opinions and refusals to indict ("no bills"), judges and grand juries across the political spectrum keep blocking the government's attempt to investigate and prosecute. With judges calling the government's actions pretext, vindictive, and abuse of prosecuting power. /3

Normally the government must meet an incredibly low bar for these to past muster. That's why these denials and blocks from federal judges and grand juries are extraordinarily rare. You just don't see them. Many prosecutors never do. /2
