Re: Equality and Human Rights Commission's Draft Code of Practice
I am writing to you regarding the Equality and Human Rights Commission's (EHRC)
Equalities Act 2010: Draft Code of Practice which was laid before Parliament on 21 May 2026 in response to the Supreme Court's judgement that, for the purposes of the Equality Act, "sex" refers to an individual's identified biological sex, at birth.
Constitutionally, it is the role of the Supreme Court to interpret the meaning of legislation and in this case Parliament's understanding of the word at the time the Equality Act was passed.
Given that the minister responsible for the passage of the Equality Act has confirmed that the ruling reflected the intention of the then-Government, the Court's judgement was correct in legal terms. I would note, however, that given it is for Parliament to determine what the law should be, the ruling does not absolve the Government from a duty to form its own opinion.
Regardless of whether or not the ruling was correct, the current issue is that parts of the EHRC'S guidance are clearly unsustainable in practice. This is evident when reading statements within the draft guidance regarding the healthere required by trans women under Codes 13.152 and Code 13.153.
The example provided under Code 13.153 states that "only women and trans men need to use" the services provided at Obstetries and Gynaecology (OBGYN) outpatient service". The guidance goes on to state that: "The outpatient service does not offer any treatment which is suitable for a man or a trans woman and therefore can refuse to treat them. The hospital can also refuse to adjust the way in which it provides the service."
The Royal College of Obstetricians and Gynaecologists (ROG) published a draft consultation document entitled "Care of Transgender and Gender Di…

While I appreciate that the RCOG has not yet published a finalised version of this document, the suggestion that OGYNservices do not offer any treatment which is suitable for...a trans woman" does not appear to be correct.
1am also concerned that - under Codes 13.152 and 13.153 - women's health clinics offering breast screenings would be unable to provide this service to trans women. This is despite the fact that trans women who have had more than five years of Gender-Affirming Hormone Therapy (GHAT) are forty-seven times more likely to develop breast cancer than men.
Additionally, 1 share the concerns expressed by many of our colleagues and my constituents regarding the practical implementation of this guidance in certain instances. Codes 13.123-13.126 appear to indicate that there could well be situations whereby there is no obligation to provide access to - for example - toilets for transgender individuals:
"However, it may be that offering alternative arrangements is not reasonably possible for the service provider (including a person providing a service in the exercise of public functions) or that doing so would undermine the service that is being provided. This may be because of the type of service being provided, the needs of the service users, the physical constraints of any building, or because of the disproportionate financial costs associated with making those arrangements" (13.126).
This appears to suggest that in situations where, due to physical constraints... or because of disproportionate financial costs" (13.126): a service provider decides it cannot also provide toilets in individual lockable rooms with handbasins" (13.123); is unable to extend access to an "accessible toilet with baby changing facility so it can also be used as a mixed-sex toilet"
(13.124); that transgender men or women could be left without access to a provision as basic as toilet facilities under the draft guidance.
