Congress defined it in the National Artificial Intelligence Initiative Act of 2020. Under 15, U.S.C. 9401(3) », "artificial intelligence" means a machine-based system that, for human-defined objectives, can make predictions, recommendations, or decisions that influence real or virtual environments.
Recent presidential orders use that statutory definition rather than replacing the name. For example, Executive Order 14179 7 (Jan. 23, 2025) says that for purposes of the order,
"artificial intelligence" or "Al" has the meaning in 15 U.S.C. 9401(3). Later orders on Al policy also keep the term "artificial intelligence""
A president can set how executive-branch agencies talk about Al in their own documents, but that does not change the law, the U.S. Code, or how the term is used outside the executive branch. Changing the statutory name or definition would take an act of Congress.
