I was frustrated and angry about how the conversation about the Twenty-Second Amendment was developing, and in an effort to prevent, idk, an entire literature from developing overnight??? I wrote something about it. we'll see how the law reviews feel about a short essay very late in the cycle.
This Essay argues that the Twenty-Second Amendment is enforceable by the states against any two-term President—including Donald Trump—who attempts to evade its requirements and seek an extraconstitutional third term anyway. Whether Trump actually seeks such a term is an open question, though he professes to be serious about doing so, and allegedly sees multiple “methods” for appearing on the ballot. The narrow argument that the Twenty-Second Amendment technically allows a third presidential term under some circumstances—i.e., by allowing a President to run for Vice President—has not been tested, but it may soon be.

If such a theory is tested, it is a reasonable fear that the U.S. Supreme Court’s decision in Trump v. Anderson may preclude state enforcement of the Twenty-Second Amendment. I argue that Anderson, which solely concerned the enforceability of Section 3 of the Fourteenth Amendment, has no purchase in this context. The context, text, and procedural demands of the Fourteenth Amendment differ in every way from the Twenty-Second Amendment. As such, states are not only free to enforce it against two-term presidents, but they must do so—because there are no other viable entry points for enforcement.

A tricky thing about modern society is that no one has any idea when they don’t die. Like, the number of lives saved by controlling air pollution in America is probably over 200,000 per year, but the number of people who think their life was saved by controlling air pollution is zero.

Yost’s complaint about how long it takes to carry out executions reminds me of a Jackson Clarion-Ledger editorial feature in the 1990s. It was a full-page spread of photos of the 40+ people on death row, how long they’d been there, and demands for “swifter justice.” 5 turned out to be innocent

I spoke to a South Carolina woman today who is miscarrying - her fetus has no heartbeat - but the state's ban is preventing doctors from taking action. She has to walk around with a dead fetus for another week so she can get a FOURTH ultrasound. This is what bans do.

Randy Fine is on track to defend #FL06 for the GOP. Though a dramatically diminished one. Two counties have almost done counting, and Fine's lead is 15-20 percentage points under Trump's margin from November. But Trump won by 30% overall, so this is enough for him.
