Even without estoppel being able to grant citizenship, perhaps a sympathetic court on sympathetic facts could hold that the removal statutes are unconstitutional as applied because of a due process violation that prevented the non-citizen from filing the proper application.

Doesn't it have to be Webster Bivens? Plus, if you know the name of the defendant, that's an entirely different situation.

The logic seems fairly straightforward. The constitution incorporates by reference states' voter qualifications, so the federal government can't imposed additional qualifications overriding those. And states could (and have in the past) allowed non-citizens to vote.

I once saw a restaurant sign that said it very well: never use a big word when a diminutive one will suffice.

Presumably because the government is the petitioner, so its brief comes first and the respondents are defending the judgment below. It seems more akin to the usual process in the courts of appeals.

And it seems (based on the description) that the injunction was an anti-arbitration injunction of sorts to have the party take all steps to ensure the bais din unwound all of its orders issued during the TRO.

A seruv in this context I think is more of a (religious) contempt order issued by a bais din (beth din, beit din, etc. depending on your preferred transliteration) directed at a party who refuses to appear after being summoned. en.wikipedia.org/wiki/Siruv

The BIA analysis also equates ineligible for naturalization with *permanently* ineligible for citizenship without any analysis of what permanent is.

It's been like this for a couple years (even back to 2024). I suspect that the ability to transmit information electronically allows for more even distribution of production. (For example a family member whose application was submitted in one city received a passport issued multiple states away)

Also, what if an LPR flies abroad while pregnant? Is the purchase of a return ticket a commercial transaction to ensure the mother is present in the US to give birth?
161
chesslaw1.bsky.social @chesslaw1.bsky.social · 06/08/2026
The surrogacy provisions also would apparently deny citizenship to the child of 2 LPRs born via a commercial surrogacy.

chesslaw1.bsky.social @chesslaw1.bsky.social · 06/08/2026
Because of that it would seemingly deny citizenship to people whom the government conceded would be citizens in the last round of litigation.

This seems ripe for a Court of Appeals to intercede. Under the decision's logic, buying a bus or plane ticket for someone to come to a port of entry and request asylum is a crime.

Imagine if you mailed the IRS a check to pay your taxes, but they left their mail unopened for years and then arrested you for failure to pay taxes. That’s effectively what ICE is doing to increasing numbers of people now; people out of status only because of GOVERNMENT delay.

Presumably the original is still reported somewhere (which the new order could have included). Also, reading between the lines, does this mean that the petition for rehearing convinced Judge Haynes not to concur in the former majority, but didn't change her vote on the judgment?

chesslaw1.bsky.social @chesslaw1.bsky.social · 30/06/2026
Gorsuch's own dissent requires domicile, but suggests that domicile is independent of immigration law. So the child of a temporary visitor is not a citizen, but the child of someone domiciled here (but in violation of immigration law), is.
