Transitional and Saving Provisions) Regulations 2026
Made - - - - 10th September 2026
The Secretary of State makes these Regulations in exercise of the powers conferred by sections 142(1) and 143(1) of the Data (Use and Access) Act 2025(a).
Citation
1. These Regulations may be cited as the Data (Use and Access) Act 2025 (Commencement
No. 9 and Transitional and Saving Provisions) Regulations 2026.
Provisions coming into force on 30th September 2026
2. The following provisions of the Data (Use and Access) Act 2025 come into force on 30th
September 2026—
(a) section 117(4)(a) (the Information Commission: omission of section 205(2)(l) of the
Data Protection Act 2018);
(b) section 118 (abolition of the office of Information Commissioner);
(c) section 119 (transfer of functions to the Information Commission).

Four years to answer FOI requests! The ICO has issued an enforcement notice against Derby Council due to its ‘exceptional level of non-compliance’ with FOI law. Only 29% answered on time, some go back to 2022!

The Information Commissioner has issued an Enforcement Notice to Derby City Council after evidence showed widespread and persistent delays in handling FOI requests. The council reported that only 29% of requests due between 1 January and 24 July 2026 were answered on time, while 59% remained overdue, with some outstanding requests dating back to 2022. The Commissioner found that these delays reflected systemic failures in the council’s FOI handling arrangements and amounted to an exceptional level of non-compliance with sections 1(1) and 10(1) of FOIA. The Notice requires the council to publish an action plan to address the causes of delay and to clear its backlog of overdue requests within six months.

Former Mid and East Antrim Council chief Anne Donaghy convicted of two charges over FoI email deletion www.irishnews.com/news/norther... #FOI #localgov
Donaghy's defence contended she had been concerned about Dame Arlene's personal email address getting into the public domain, as there had been an issue with information being leaked from the council.

However the prosecution argued an audio recording from Donaghy's assistants' Live Scribe pen, during which Donaghy is heard saying "Oh no" when told the FOI team had a copy of the email to Dame Arlene, indicates she had not known a hard copy of the email existed.

Delivering her judgment, Judge McSorley said the question is whether Donaghy had intended by deleting the email to erase a record.

She found Donaghy had been concerned about the perception that she was close to the DUP, and was under mounting political pressure by the point she ordered her personal assistant to delete the email to Dame Arlene.

The judge noted Donaghy's response in the recording to being told of a hard copy of the email was among factors that led her to the "irretrievable conclusion" she had intended to prevent the email being disclosed.
