You can use sex as a shorthand label to DESCRIBE a set of biological features that usually occur on one of two combinations. It's handy to be able to say "male" instead of "functioning penis and testicles, testosterone at healthy levels, good response to that testosterone, presumably fertile"

The reason for this absurd definition, which was set into law by the supreme court many years after the equality act was written and put into place by an institutionally transphobic court that refused to allow any trans rights group standing to speak, is because you can't use biology to define sex.

Reminder that "biological sex" is not a thing that exists. It is a legal fiction in every place that refers to it. In the UK, in the equality act, it means "the sex that was written on your original birth certificate." Incidentally, it doesn't matter if that's due to a clerical error.
