I just got the notice that thanks to inflation the fee to not have your asylum case decided this year is going to be higher than the fee to not have your asylum case decided last year.

It sure seems like there should be some type of judicial process to determine whether people broke the law before you declare that they broke the law and should be and are being punished for it. We could dedicate an entire executive office for that sort of immigration review.

JFC. Another unsigned ruling by rank cowards. How many dead bodies will the fascist Justices be responsible for by the time the next hearing date rolls around in December?. Fascist Supreme Court Justices are an enemy of the people's rights. Pack the court, soonest. Or else lose the Republic entire.

The BIA with a death blow to the adversarial system in immigration court. I'm not sure why they're not just interlocutorily ordering everyone removed sua sponte. Think of the efficiency if they just skipped proceedings entirely and denied appeals people couldn't lodge.

They're going after it because Congress unconstitutionally delegated unreviewable discretion to end it and the iniquitous Supreme Court expanded that unreviewable discretion to exclude even reviews of procedural flaws. It's now the lowest-hanging fruit for people who hate immigration.

I had some time to dive into this. There's an ICR entry from a few weeks ago captioned as "No material or nonsubstantive change to a currently approved collection". I call bullshit. This is a misclassification to avoid public comment on a major change.

This isn't even accurate. Termination of TPS doesn't mean people are present illegally. It just means TPS is terminated. There are lots of people with pending cases for permanent residence or asylum (and probably some who still have valid nonimmigrant status though I would doubt it's very many).

These people must have some sort of fetish for having their fees shot down in court. You can't just throw a $100k fee on anything you don't like. It's limited to being revenue neutral. Anything beyond is a tax. $100,000 for OPT? For lottery entries? Get fucking serious.

I'll believe this when visas start issuing. Until then some combination of _Hawaii_ and consular nonreviewabilty are going to block this quickly. And the latter will make actually enforcing the decision virtually impossible even if technically sound.
