Oh agreed, when we applied for ESA I had to provide proof of my child's disability to qualify, not sure what changed but I actually think the program (if it remains) should be limited to special needs kids, not for already rich families that just want a religious school.

My child is disabled and non-verbal autistic, we use ESA money so that he can go to a private school for kids with Autism. It would be devastating for families like ours to lose ESA. If we do then that money needs to be used for the public schools to be able to accommodate kids like mine.
