Appendix C — Trump's Transactional Diplomacy: Offers, Leverage and the Limits of a Deal
Donald Trump’s public language frequently treats international negotiations as exchanges: one party offers something the other wants, demands a concession and presents the outcome as a deal. That approach is neither unprecedented nor inherently illegitimate. Diplomacy routinely involves bargains. The relevant question is whether the proposed exchange identifies real leverage, obtains enforceable commitments and protects interests that cannot be reduced to a short-term political announcement.
The documentary record shows considerable variation. Some negotiations produced binding or partially implemented changes. Others yielded declarations with uncertain follow-through, or disputes over whether the president could lawfully apply the pressure involved. A transactional pattern is therefore a hypothesis to test across decisions, not a universal explanation of Trump’s motives.
Ukraine in 2019: Leverage and Legal Authority
The clearest example of leverage constrained by institutional rules is the withholding of security assistance to Ukraine in 2019. The U.S. Government Accountability Office concluded on 16-Jan-2020 that the Office of Management and Budget violated the Impoundment Control Act by withholding approximately $214 million in appropriated Defence Department assistance for a policy reason. The administration’s foreign-policy preferences did not authorize it to suspend spending directed by Congress.1
That decision establishes a legal violation in the withholding of funds, not every disputed allegation about presidential intent. It does, however, demonstrate that leverage cannot be evaluated solely by whether the executive branch can temporarily control it. The lawful authority to withhold a benefit, the conditions demanded and the effects on the recipient are separate questions.North Korea: Diplomatic Access Without Verified Disarmament
The Singapore joint statement of 12-Jun-2018 illustrates a different kind of transaction. Trump and Kim Jong Un committed to improved relations and a peace regime, while Kim reaffirmed a commitment to denuclearization of the Korean Peninsula. The statement supplied broad objectives but no detailed, verifiable dismantlement timetable.2
The summit represented meaningful diplomatic access and reduced some immediate tensions, but the statement alone did not accomplish denuclearization. Public ceremonies and signed declarations must be judged separately from implementation. The North Korean example is especially relevant to claims that personal rapport can substitute for detailed reciprocal obligations.
China: Negotiated Commitments and Disappointing Delivery
The U.S.–China Phase One trade agreement, signed in Jan-2020, placed extensive economic commitments on paper. It included market-access changes, intellectual-property provisions and targets for Chinese purchases of American goods and services. Yet the Office of the United States Trade Representative subsequently reported that China fell far short of the specified purchase commitments for 2020 and 2021, while implementing some other provisions. It also found that the agreement did not fundamentally alter China’s state-led economic system.3
That mixed result is more informative than declaring the negotiation either a triumph or a failure. A concession recorded in a signed text is not automatically a concession fully performed. Conversely, underperformance on headline purchases does not nullify every regulatory change achieved. The documentary record demands outcome-by-outcome assessment.NATO: An Agreement that Complicates the Caricature
The 25-Jun-2025 Hague Summit Declaration committed NATO members to devote five per cent of gross domestic product to core defence and related security spending by 2035, including at least 3.5 per cent for core defence. The declaration reaffirmed Article 5 and support for Ukraine. The outcome coincided with long-standing American pressure for higher allied contributions, including pressure from Trump.4
It would be inaccurate to attribute the entire agreement to Trump’s bargaining alone; the alliance had its own assessment of Russia and military capability requirements. Yet the declaration shows why a transactional style cannot simply be equated with concessions to adversaries. Negotiating pressure can also coincide with additional commitments by allies, and an agreed long-term spending target is different from verified expenditure already made.
The Diesel Case: an Early Concession and a Delayed Test
The Oct-2026 Russian diesel arrangement makes the distinction unusually sharp. Trump announced additional supply intended to ease high fuel prices ahead of congressional elections. American sanctions relief was authorized immediately, while shipments, durable retail savings and Russian conduct in Ukraine remained to be measured.5
A lawful sanctions exception can be justified if it produces adequate economic or diplomatic benefits. But evaluating it requires asking who initiated the proposal, what each side could withhold, what was made legally enforceable, what was merely promised and how easily the policy could be reversed. A direct benefit to a president’s public standing may coexist with a genuine policy objective; neither can be inferred to be the sole motive from timing alone.
Across these episodes, the recurring concern is not the presence of bargaining. It is the gap that can open between an announced exchange and demonstratedperformance. The North Korea statement lacked verifiable detail; China’s purchase commitments went substantially unmet; Ukraine’s assistance withholding encountered a statutory limit; NATO produced an agreed long-term framework whose execution still depends on members. These differing results caution against treating any presidential claim of agreement as sufficient proof of success.
The diesel arrangement should be measured by that same standard. Did the United States receive a benefit that was demonstrable, timely and proportionate to the sanctions flexibility it granted? The documentary answer, as of 11-Oct-2026, remains incomplete.

Appendix B — Russia, China, Iran and North Korea: Cooperation Without a Common Command ⤵
Appendix B — Russia, China, Iran and North Korea: Cooperation Without a Common Command
A foreign government need not coordinate an operation to learn from it. That distinction is essential when examining whether the Russian diesel arrangement of Oct-2026 could influence calculations in Beijing, Tehran and Pyongyang. The four governments cooperate in ways that matter to American security, but shared opposition to aspects of U.S. policy does not make them a single strategic actor.
The Network is Unequal and Selective
The U.S. intelligence community’s 2026 Annual Threat Assessment describes selective cooperation among China, Russia, Iran and North Korea, driven partly by a shared interest in countering American pressure. It also cautions that their relationships are primarily bilateral and that a sweeping concept of adversarial alignment overstates the depth of their cooperation. Economic ties with China help Moscow and Tehran withstand sanctions; Iranian and North Korean military support has assisted Russia’s war against Ukraine. Divergent interests and concern about direct confrontation with the United States constrain cooperation.1
Research by the Center for Strategic and International Studies reaches a compatible but more detailed conclusion. Military and security cooperation accelerated after Russia’s full-scale invasion in 2022, through arms transfers, dual-use technology, a Russia-North Korea mutual defence pact and joint exercises. The documented cooperation is principally bilateral or trilateral; the researchers found no discernible official four-way security cooperation.2
Those qualifications are important. China’s trade relationship with Russia is not equivalent to North Korea’s direct military assistance. Iran’s regional security priorities differ from Beijing’s trade and Taiwan calculations. All four can resistWestern sanctions or policies for their own reasons while disagreeing about the risks and rewards of escalation.
What Travels Between Governments
Cooperation may transmit hardware, manufacturing inputs, financing arrangements, operational experience and information. Yet it would be an error to assume every kind of intelligence, software or military technology circulates freely among all four states. Access is selective, affected by trust, sanctions exposure, bargaining power and the possibility that sensitive capabilities could later be used against the supplier.1,2
Political lessons can travel without any formal transfer. Diplomats follow public statements and legal changes. Economic officials watch sanctions waivers, commodity flows and payments. Intelligence organizations study discrepancies between announced policies and observed outcomes. Publicly visible events are therefore available for analysis even to governments that receive no special briefing from Moscow.
The diesel arrangement offers such an event. Russia publicly promised diesel supplies and the United States authorized specified transactions involving Russian-origin fuel; simultaneously, Washington was pressing Ukraine to halt strikes on Russian refineries. A later announcement of an energy ceasefire had not been confirmed by both belligerents on 11-Oct-2026.3,4
An analyst in another capital could reasonably ask whether a politically urgent American fuel-price problem altered Washington’s sanctions posture. But there are further questions: how much additional diesel reached buyers, what economic relief followed, and whether Ukraine changed its operations? Until those outcomes are established, the episode supplies a case to observe, not a proven operating formula.Four Capitals, Four Different Interests
Beijing could examine the relative weight Washington places on economic disruption, commercial negotiations and alliance commitments. Yet China’s exposure to American and global markets makes the costs of conflict distinct from Russia’s. A tactical opportunity that appeals to Moscow could impose unacceptable costs on Beijing.
Tehran could be interested in whether energy-market pressure increases American willingness to grant sanctions exceptions. But Iranian policy is shaped by its own regional conflicts and the direct effects of U.S. military operations; analogy is not identity. Pyongyang might pay closer attention to security guarantees, military exercises and the durability of presidential assurances. None of these potential interpretations demonstrates that the governments adopted them after the diesel announcement.
A particularly instructive counterexample is the United States’ own institutional resistance. Congress can contest sanctions relief; foreign governments cannot assume that one presidential decision will permanently override legislation, commercial constraints, allies or a later administration. Other states may interpret a short-term concession as evidence of bargaining flexibility rather than enduring American weakness.
A Demonstration Need Not Be Deliberate
The strongest claim — that Putin staged the diesel bargain to teach allied adversaries how to manipulate Trump — requires evidence of strategic intent: communications, instructions, briefings or trustworthy first-hand accounts. Publicly accessible reporting does not yet establish such a purpose.A weaker and more defensible claim is that the governments can independently observe what Washington offered and what Moscow obtained. The relevant mechanism is adversarial learning without proven coordination. It is plausible because these states monitor American conduct and have demonstrable channels of cooperation. It remains to be shown that any of them changed its strategy because of this particular transaction.
That distinction preserves the diesel essay’s central concern while keeping the four governments’ separate interests visible. The question is not whether they belong to a single gang with one plan. It is whether the recorded consequences of American decisions alter the calculations of governments already seeking leverage over Washington.

As of 11-Oct-2026, the public record establishes the announced Russian quantities, a broad but qualified American diesel licence, an immediate wholesale-market response, pressure on Ukraine over refinery attacks and Trump’s unconfirmed declaration of an energy ceasefire. It does not establish the volume of Russian fuel actually delivered under the arrangement, the retail-price saving attributable to it, a binding unilateral Ukrainian concession or Putin’s alleged intention to instruct other adversaries.
The balance can still change. Confirmed exports, independently measured price effects, enforceable reciprocal steps on energy attacks and the future of sanctions would materially alter the assessment. So would evidence showing who initiated the negotiation and exactly what each government demanded.
For now, the central concern is specific: Washington granted a legal concession whose scope extends beyond the announced cargoes, while the economic relief offered in return remains contingent and the strategic consequences for Ukraine are unsettled. That is substantial enough to warrant scrutiny, without claiming that Putin’s supposed trap has already been proved.

Précis of Austin Sarat's Legal and Political Opinion Essay, with Historical Analysis and Commentary on Capital Punishment and State Power
A Military Execution Made Public
Defense Secretary Pete Hegseth announced plans to execute Nidal Hasan, convicted of murdering 13 people at Fort Hood in 2009, by firing squad on 03-Dec-2026. The proposed livestream would allow the public to witness the killing. Hegseth deliberately selected the original crime scene, weekday and hour, presenting the execution as a warning about the consequences of such violence. Legal scholar Austin Sarat argues that these arrangements are designed to make the government’s use of lethal force a public spectacle.
America's Abandoned Tradition
Sarat traces public executions from their supposed purpose as lessons in justice and repentance to the unruly, often racially charged spectacles they became. The last public execution, in Kentucky in 1936, attracted thousands to witness the hanging of Rainey Bethea, a Black man. Such events eventually became symbols of cruelty and racial intimidation rather than civic instruction. Broadcasting an execution to an unlimited audience, Sarat argues, would resurrect that discredited tradition through modern technology.
Punishment as Spectacle
Hegseth presents public viewing as deterrence. Sarat rejects that justification, arguing that televising a firing squad would invite audiences to consume another person’s death as entertainment. He compares the proposed broadcast to a government-produced film of an actual killing, stripped of the restraint ordinarily associated with the administration of justice. Sarat further suspects that Hasan’s Muslim identity helps explain Hegseth’s determination to make this particular execution public. The Cost to Military Justice
Sarat does not dispute the gravity of Hasan’s crimes. His objection concerns what the government proposes to do with the punishment: transform a lawful sentence into an exhibition of state violence. He concludes that such a display would dishonour the military, degrade public standards of decency and associate American justice with practices the country once repudiated.

Russia’s emergency procedures are apparently well established: when disaster strikes, contain the truth before containing the threat. The Chernobyl playbook still makes for handy reading. ☣️📖🤐 Помни! Remember! #BillBramhall #PoliticalCartoon
Bill Bramhall editorial cartoon depicting Russia as a figure in a bulky yellow hazmat suit, grey gloves and boots, a full-face respirator, and a red breathing apparatus strapped to its back. “RUSSIA” is printed across the suit’s chest. The figure calmly reads an open manual titled “CHERNOBYL COVER-UP” while standing beside a broken laboratory vial labelled “PLAGUE.” A sickly green vapour curls upward from the vial, forming a sinister skull. A speech bubble above the figure declares, “RELAX– WE HAVE PROCEDURES IN PLACE.” The juxtaposition mocks Russia’s assurances of preparedness, suggesting that its established response to catastrophe is to conceal the danger rather than confront it. The reference to the Soviet cover-up of the 1986 Chernobyl nuclear disaster reinforces the cartoon’s warning about official secrecy and public safety. Signed “Bramhall ’26” and “NYDN” at bottom right.

Welcome to the 𝔽𝕠𝕝𝕚𝕖𝕤 𝔹𝕦𝕣𝕘𝕖𝕣❕ 🍔 Trump’s busy stuffing his face, his GOP horse is practically running on fumes, and the Democrats are kicking up dust ahead. Quite the handicap for the 2026 race. 🐎💨 #ClayBennett #Midterms2026
Clay Bennett editorial cartoon titled “THE 2026 RACE.” Donald Trump, caricatured as a heavyset jockey, wears a red-and-white cap, a red racing jacket with “47” on the sleeve, white breeches and black riding boots. He sits atop a weary brown horse whose red saddlecloth bears the Republican elephant emblem. Oblivious to the competition, Trump eats a hamburger with one hand while loosely holding the reins with the other. His horse trudges along with its head hanging low, eyes weary and tongue dangling from its mouth. At the right edge, a rival horse bearing a blue saddlecloth with the Democratic “D” emblem gallops out of the frame, kicking up dirt. The contrast suggests a Republican campaign weighed down by its own rider while the Democrats pull ahead. Bennett’s signature and the Chattanooga Times Free Press credit appear at bottom left.
