1/23 Sorry, this will be long... There is a lot of shouting about what happened in the Channel yesterday. So I want to go back to basic law. Not immigration policies or political rhetoric. At sea, the starting point is simple: Preservation of life comes first under all maritime conventions.

Worrying scenes in the Channel today, for all interested in asylum policy and maritime tactics. A small boat from Normandy spent more than 30 hours at sea. Those on board now on their 2nd rescue vessel as Border Force forced to play cat and mouse with far-right activists who have their own boat.

Amazing thread. One added note - My understanding is that prosecuting under Part II of the Aviation and Maritime Security Act 1990 (which includes s11) would require active consent from the Attorney General (Ellie Reeves) rather than it being something that CPS/DPP could decide alone.

When he tried this shit in France he was arrested. Deported and permanently banned. Him and Bridge escaped a potential prison sentence. I assume his lawyer has advised him before the incident what he can get away with.

2/23 That principle is not something invented by the RNLI, Border Force or the French authorities. It is embedded in international maritime law. UNCLOS Article 98 requires ships to render assistance to people in danger at sea and to proceed to their rescue where reasonably possible.

Excellent work Ash - thanks for educating folks - wouldn’t hurt for the muppets to serve some time at sea methinks - served in the RN (aircraft tech on helicopters) - terrifying being at sea in a storm - often operating our helo from a small ships flight deck in less than perfect conditions for SAR

Thank you for presenting such a clear and factual analysis. My reading of this is that a Govt that does not pursue acts demonstrating such flagrant disregard for safety at sea through all applicable laws is complicit in condoning them. Does our new PM have the cojones to do this?

Great thread, thanks for sharing. I posed questions before serving your post, interested to hear your thoughts, if you get chance. (Obviously, ignore the piracy content…)

Now, if anyone can tell me, it'll be you. Isn't there a general offence of causing danger to life at sea? I know there's an offence specifically for seamen on British registered ships (S.58 MSA 1995), but I doubt Thomas's boat is registered so this section wouldn't apply, would it?
