ET: Ever since that movie, things in the US have only gotten worse in terms of the climate crisis. Have you had any luck in bringing people along in terms of at least your circles in Hollywood?

McKay: You know, it's both sad and positive, because for the most part, no. I've learned a lot about the mind-altering effects of privilege, money, and ego. But then there have been people, and whenever they step up, it's kind of like a mini miracle. So, there are people that are waking up.

When I made the movie, and in the year or two afterwards, pretty much everyone treated me like I was crazy, I was overreacting. And that's not really the case anymore. Now, all that really matters is who is being active.

In Maricopa County, Arizona, which has put in place systems to more accurately count heat deaths, the number of people murdered by Big Oil's extreme heat now averages TWENTY SEVEN TIMES more than the number murdered by murder: 413 to 15.

Climate Homicide: Prosecuting Big Oil For Climate Deaths

Prosecutors regularly bring homicide charges against individuals and corporations whose reckless or negligent acts or omissions cause unintentional deaths. Fossil fuel companies learned decades ago that what they produced, marketed, and sold would generate “globally catastrophic” climate change. Rather than alert the public and curtail their operations, they worked to deceive the public about these harms and prevent regulation of their lethal conduct. They funded efforts to call sound science into doubt and confuse their shareholders, consumers, and regulators. They poured money into campaigns to elect or install judges, legislators, and executive officials hostile to any litigation, regulation, or competition that might limit their profits. Today, the climate change that they forecast has already killed thousands of people in the United States, and it is expected to become increasingly lethal for the foreseeable future. Given the extreme lethality of fossil fuel companies’ conduct and their longstanding awareness of the catastrophic consequences, should they be charged with homicide? Could they be convicted? In answering these questions, this Article makes several contributions to our understanding of criminal law and the role it could play in combating crimes committed at a massive scale. It describes the doctrinal and social predicates of homicide prosecutions where multiple corporate actors have engaged in conduct that endangers much or all of the public. **The Article finds that in jurisdictions across the United States, fossil fuel companies could be prosecuted for every type of homicide short of first degree murder,** a charge it does not evaluate. It also concludes that prosecutions could offer highly effective remedies and that prosecutors should be motivated to seek them.

New Zealand looks to be the best place to hedge impact from severe El Niño shocks to global food supply chains, according to Bank of America. “Historically, El Niño has been associated with widespread crop losses across key exporting regions, and current risks are amplified by elevated fertilizer prices and lingering supply-chain disruptions,” BofA strategist Oliver Levingston said. While a major El Niño weather event posed growing risks to the global food supply chains and shortages in fertilizer inputs have been disrupted by the developments in the Strait of Hormuz, New Zealand’s outsized dependence on agricultural exports would mean that a sustained trouble for the global food supply “is likely to be a positive terms-of-trade shock,” the bank noted.

Also stunning: Loss and death from Big Oil's wildfire smoke has NOT been included in estimates of the costs of climate damages... ...but the cost of Big Oil's wildfire smoke is so massive, it exceeds estimates of ALL OTHER climate damages combined.
But I think there’s an even bigger lesson here. Ten years ago, virtually no one talked about wildfire smoke as a serious climate impact. According to climate economists I surveyed on Bluesky, it is not really included in economic damage estimates of climate change. It turns out to be pretty costly, as Meyer described:

How costly? “When monetized,” a group of Stanford and Princeton economists wrote in Nature last year, in the first major study on the topic, “the climate-driven smoke deaths result in economic damages that exceed existing estimates of climate-driven damages from all other causes combined in the U.S.A.”

You read that right: The cost of climate-worsened wildfire smoke alone is larger than what earlier studies said every other estimated cost of climate change would be, combined.

But the scale and threat of this coming warming event is simply too large to ignore in the name of business/politics as usual.

States, cities, and counties should be immediately:

- reinforcing river banks and lakes against all time high cresting numbers
- increasing funding for fire fighting and rescue
- running geological tests on populated hillsides
- bolstering power grids
- building more tornado shelters, cooling and high ground centers
- increasing life guards and warning systems for beaches
- informing citizens of potentially life threatening increased risk

Instead the signatories of this cry for action see mostly silence and inaction.

In some places, Big Oil is now murdering more people than all other murders combined. The question is: Will prosecutors keep letting them get away with it.
Finally, there’s involuntary manslaughter – the crime of recklessly causing (or, in many states, substantially contributing to) the death of another person. Clearly, climate-caused deaths are accelerating – a recent analysis found that extreme heat from climate change may have caused more than 20,000 deaths in Europe last month alone. Already, there are victims and survivors who are connecting the dots to big oil. Earlier this month, a Washington state court ruled that a lawsuit against the fossil fuel industry for the wrongful death of the plaintiff’s mother in a climate-induced heatwave will proceed toward discovery and trial. Prosecutors could follow suit and begin charging big oil companies in relation to the climate disasters that are, in some instances, taking the lives of more of their constituents than are being lost to traditional homicides.

In fact, the story that somehow has not become standard is that climate scientists pulled off something that was extraordinary in intellectual terms. They got the basic outlines of what was coming and in many ways even the numbers on what was coming right decades in advance. In any kind of rational world we would be hailing them as heroes and very much listening to them about what we should be doing now.

Of course where we are is that climate scientists are reviled.

Probably just for the Christmas card list... A shady, Big-Oil backed effort is "collecting hundred of emails and other documents" to smear and intimidate the 15 scientists conducting a report that could expose the damage cost of fossil fuel pollution in *individual* extreme weather catastrophes.
The scientific strides stand to send shock waves through the energy sector. The studies are sporadically being used to help build climate liability cases against oil and gas companies. But lawyers, scientists and insurers expect them to increasingly appear in court filings.

The commercial stakes are enormous. A 2022 analysis from a financial industry forum found that fossil fuel companies could face cumulative losses of “over $100 billion in the most severe litigation outcome,” citing data from the consulting company Verisk Analytics. Since then, more than a dozen new climate liability cases have been filed, including one lawsuit that is seeking more than $51.5 billion in compensation related to a deadly heat wave.

Fossil fuels account for about 75% of all heat-trapping pollution. Agriculture and land use changes are most of the other 25%. About 15-20% is just from meat and dairy (land use for grazing, land use and pollution for growing feed, methane released by the animals.) These are just the facts 🤷‍♂️.

Case in point: Even Pew apparently does not understand that "environmentally friendly" behaviors should focus on cutting heat trapping pollution, eg: Electrification/switching to clean energy, using less plastic, eating plant-based, and supporting elected leaders who will use laws to cut pollution.
