Proposed GHG Protocol changes could chill corporate clean energy investment. Forcing local hourly matching ignores cross-border grid realities, creates artificial scarcity, and locks out smaller buyers. We need accounting that reflects and maximizes real impact, not “more accurate” on-paper claims.

Scaling Laws: Facts & Myths About AI's Energy Usage with Gavin McCormick
In this episode of Scaling Laws, we explore how the "black box" of global greenhouse gas emissions is being cracked open by artificial intelligence and satellite imagery. Kevin Frazier, Director of the AI Innovation and Law Program at the University of Texas School of Law and a Senior Fellow at the Abundance Institute, talks with Gavin McCormick, the founder of ClimateTrace, a global coalition that has revolutionized the process of identifying and quantifying emissions. For decades, climate policy has relied on self-reported data from nations and corporations—a system prone to gaps and "greenwashing." McCormick’s work leverages machine learning to monitor every major source of emissions on Earth in near real-time. We discuss the legal implications of "radical transparency," how AI-driven data can be used to enforce regulations and measure claims, and the myths and facts of AI’s environmental consequences. To get in touch with us, email scalinglaws@lawfaremedia.org. Logan Le-Jeffries, a member of the AI Wranglers student program at the University of Texas School of Law, provided research assistance with this episode.

Do people choose clean energy when given the choice? A new BMW study involving WattTime data shows that, when they’re “nudged,” drivers often shift EV charging to times when the grid is cleaner. Proof that actionable data + awareness can mean lower emissions. link.springer.com/article/10.1...

Behavioral interventions steering CO2-optimal electric vehicle charging: Evidence from a BMW field experiment in the Netherlands - Journal of Industrial Ecology
This study examines how behavioral interventions can support resilient urban energy systems by promoting CO2-optimal electric vehicle (EV) charging during periods of lowest grid carbon intensity. We conducted a two-phase field experiment in the Netherlands with 355 BMW EV drivers. We randomly assigned participants to three intervention groups (forecast, statistics, gamification) and a control group. By applying a mixed-methods design, we analyzed 13,153 charging sessions using a difference-in-differences framework and a binary logit model. We complemented these findings with qualitative insights from semi-structured interviews with 14 participants. Our results show a significant increase in CO2-optimal charging in the gamification group compared to the control group, suggesting a potential for reducing carbon emissions associated with charging. Hence, the intervention, which combines CO2-forecast, charging statistics, and gamification-based badges, is more effective in shifting charging behavior than interventions that include only the forecast or the forecast with statistics. Further analysis indicated a higher likelihood of optimal charging among drivers living in rural areas, driving a battery electric vehicle, and charging on rest days. The interview findings suggest that sustained motivation for optimal charging requires both alignment with individual motives and seamless integration into daily routines. By linking individual charging decisions to urban system benefits, the study highlights the potential of behavioral strategies to complement the integration of renewable energy sources and support resilient charging infrastructures.

Navigating the Greenhouse Gas Protocol’s Scope 2 public comment period: What you need to know
Webinar recording from live session on December 5th, 2025. On October 20, The Greenhouse Gas Protocol (GHGP) released once-in-a-decade proposed revisions to its Scope 2 accounting framework for public comment. These revised guidelines are expected to change not only how organizations report on their emissions, but also incentivize different procurement behaviors as companies attempt to reach ambitious clean energy and climate goals. The core GHGP Scope 2 proposal includes a local-only hourly matching requirement for inventory accounting, along with a separate proposal for voluntary consequential or impact accounting. Today, however, these proposed guidelines remain largely theoretical to most organizations. Stakeholders need a clear and comprehensive understanding of how GHGP Scope 2 changes will directly impact them, as well as how potential changes will impact grid decarbonization in the real world. WattTime’s Gavin McCormick, Henry Richardson, and Chandni Sinha Das share an overview of the currently proposed GHGP Scope 2 accounting revisions and explain how they might affect companies’ Scope 2 emissions totals, renewable energy procurement costs, real-world emissions impacts, and more. They ensure participants are equipped with the necessary information to engage meaningfully in the GHGP open comment period before it closes on January 31, 2025.
