The Final Battle for America’s Democracy
Forget November 3. It’s January 3 when Donald Trump and his MAGA Republicans might bury our democracy once and for all. Here’s how.

The right-wing attack on birthright citizenship is not just about birthright citizenship itself. As MAGA’s reaction to the Supreme Court ruling proves, it is part of their opposition to a broader ideal, that “All men are created equal.” www.theatlantic.com/ideas/2026/0...
Elsewhere, less tactful conservatives expressed directly what the dissenting justices chose to do in euphemism. Stephen Miller, who runs immigration policy for the Trump administration, told Fox News that “we have people from all over the world, from third-world nations, nations that on their own would have never invented the wheel, let alone modern technology, let alone medicine, let alone air travel.” He went on: “They can just come into the country, have a baby at a hospital paid for by you and me, and then that baby is automatically a citizen? That baby can sit on a jury when he turns 18 and sit in judgment of you and sit in judgment of me and sit in judgment of our loved ones? Can decide who our mayors are? Our governors are? Our presidents are?” Miller’s long-standing view is that what ruined America was the repeal of eugenics-inspired immigration restrictions that had banned immigration from Asia and Africa and from nations in Europe deemed to be composed of lesser white races.

There is very little difference between Miller’s position—if you come from a “Third World nation,” you are inferior—and that of antebellum Democrats and the opponents of the Fourteenth Amendment at the time it was adopted: American citizenship is degraded by having to share it with the biologically inferior. The justices are elite lawyers with the ability to obfuscate this project and ignore its aims, but the rest of us need not pretend. To put it bluntly, Miller’s objection, as articulated here, is not to birthright citizenship. It is to the idea that “all men are created equal.”

This is EXTREMELY disturbing. It seems the reason for killing over 200 fishermen - in small boats, many hundreds of miles from the US, posing no threat whatsoever to anyone - is just to keep Trump entertained. This is entirely consistent with the callous sadism that runs through the Epstein files.

Significant development on $1.8 billion fund: Federal court responds favorably to motion by 35 former federal judges. Their motion asked court reopen the case to see whether a fraud was perpetrated on the court to effectuate the "settlement." Judge responds⤵️
Here, the non-party movants advance grievous allegations that Plaintiffs voluntarily dismissed this litigation solely to avoid judicial scrutiny of a lawsuit that “was collusive from the start” and was only filed to provide the imprimatur of legality for an unlawful settlement. (DE 63 at 16). They point to the fact that the settlement in question includes a “three-paragraph addendum2 . . . [that] purports to ‘forever bar[] and preclude[]’ the United States from pursuing claims that could have been [otherwise] asserted [against] Plaintiffs,” (Id. at 8), and highlight the fact that Defendants did not “even try[] to defend against Plaintiffs’ claims” despite their active opposition to nearly identical claims in other litigation.3 (Id. at 16). Finally, the non-party movants assert that Plaintiffs’ claims were “clearly untimely” and therefore untenable. (Id.).
Accordingly, it is ORDERED AND ADJUDGED that Plaintiffs shall file a response to the Motion (DE 63) on or before June 12, 2026, detailing their position on the matters set forth in the Motion, including (1) the charges of collusion and whether the Parties are truly adverse; (2) the assertion that the dismissal in this case was premised on deception by the Parties; and (3) the question of whether the case should be reopened because the Court was the “victim of a fraud.” (DE 63 at 13, citing 11 Charles Alan Wright & Arthur R. Miller, Federal Practice and Procedure § 2870 (3d ed.)). The non-party movants may, if they choose, file a reply on or before June 19, 2026. DONE AND ORDERED in Chambers in Miami, Florida, on this 29th day of May, 2026.

John Lewis had John Roberts' number from the jump: takebackthecourt.substack.com/p/john-lewis...
Take Back the Court REP. JOHN LEWIS: In 1965, Jurist Roberts was only 10-years-old. He may be a brilliant lawyer, but I wonder whether he can really understand the depth of what it took to get the Voting Rights Act passed. The right to vote is precious, almost
sacred. It is the most powerful non-violent tool we have in a democratic society. As many of you know, I gave a little blood on the Edmund Pettus Bridge, but some
of my friends and colleagues gave all they had, their very lives for the right to vote. I feel that if Judge Roberts is confirmed to be the Chief Justice of the United States, the Supreme Court would no longer hear the people's cries for justice. I feel that the leadership of the Court will promote politics over the protection of individual rights and liberties. If the Federal Courts had abandoned us in the civil rights movement in the name of judicial restraint, we might still be struggling with the
burden of legal segregation in America today. Jurist Roberts's memos reveal him to be hostile towards civil rights, affirmative action and the Voting Rights Act. He has even said that Voting Rights Act
violations, and I quote, "should not be made too easy to prove.'

Feels appropriate to point out on No Kings day: Allowing Trump to selectively pay employees he likes, when he feels like it, rather than having Congress solve the problem, is a real constitutional threat. From @joshchafetz.bsky.social donmoynihan.substack.com/p/mike-johns...
These actions aren't just illegal, although they are that. They aren't just unconstitutional, although they are that. They are anti-constitutional: they strike at the core of one of the principles that allows our entire constitutional order to function.

From the Founding through the present day, the power of the purse has been understood as one of Congress's most potent tools against the executive: the executive can't do anything without money, and he can't spend money without Congress. If Trump is able to get away with ignoring that, with arrogating the entire power of the purse to himself, then Congress has pretty much no way of checking him.
