Coke Morgan Stewart, who spent the last 18 months hollowing out the PTAB, is now the president and CEO of C4IP — a lobbying group funded with millions of dollars from unnamed sources and run by former PTO leaders who push pharma-friendly patent policy and smear nonprofits.

One of the easiest ways to root out patent abuse is to scrutinize every instance a corporation claims they are "innovating.” It’s code for lifecycle management, i.e. squeezing maximum revenue from existing products while minimizing investment.

Pharma companies love to claim that trivial tweaks, like a piece of plastic connecting a cap to an inhaler, are "innovations” because they know they have successfully stripped the U.S. patent system of its ability to distinguish phony “innovations” from real invention.

Thanks to Paula Newton for having me on tonight to talk about the misguided patent policies enabling Novo Nordisk to extend its U.S. semaglutide monopoly. The evidence is more clear than ever that the patent system is delivering for pharma and shareholders/investors, not patients.

Congress didn't finish investigating AbbVie until after the company had spent years fleecing patients behind Humira's patent thicket. Glad at least one senator is willing to take on Merck now rather than letting more patients suffer because they can't afford a $200K cancer drug.

On May 18th the FDA approved the first interchangeable biosimilar for Simponi, J&J’s biologic for rheumatoid arthritis and ulcerative colitis that costs American patients and payers $1.2 billion a year.

The FDA is considering banning semaglutide compounders (as well as tirzepatide and liraglutide). If they do, the market will return to its monopolistic state after a brief stint where patients had access to lower-cost alternatives to Novo’s Ozempic and Wegovy.

Good that both parties are connecting affordability to root causes. And good that pharma is losing some "friends". If we really want to see lower drug prices, we’ll need to see more “unfriending” of the pharmaceutical lobby, especially within the PTO and FDA.
