BREAKING: SCOTUS allows the Trump admin to restart third-country removals under a policy found by lower courts to violate federal law. The Democratic appointees dissent. The deportations will be OK'ed at least through the next several months, with SCOTUS agreeing to hear the case in December.

From 16,000 to 185 to Zero. The Trump admin claimed as many as 16,000 noncitizens had been registered to vote in Nevada. Then DHS came back and said the number was actually 185. This week, Nevada told the admin every single person on the list was a lawful citizen.

9th Cir., 2-1, holds that a failure of the Board of Immigration Appeals to consider record evidence (just straight-up ignored the evidence) is a reviewable legal error, not a factual error outside of the court's jurisdiction. cdn.ca9.uscourts.gov/datastore/op...
An “obvious” factual error is still a factual error. See Patel, 596 U.S. at 334, 339. But failing to consider critical evidence is legal error. If we were to adopt the dissent’s position, the agency could completely abdicate its role in cases involving the jurisdictional bar, refuse to consider any evidence in the record, and simply conclude that a petitioner failed to submit evidence. In the dissent’s view, that would be an unreviewable “factual determination.” We reject this absurd result. In short, the BIA legally erred by failing to consider Perez-Garcia’s proof of payment of his voluntary departure bond.

Incredible. First Secretary Mullin claimed that DHS had identified 15,903 noncitizens on Nevada’s voter roll. Then DHS officials told a skeptical Nevada, no no no, that’s just people we flagged. Here are the names of 185 people we KNOW aren’t citizens. All 185 were citizens. DHS got 100% wrong.
When the Department of Homeland Security sent Nevada a list of 185 names last month that it claimed identified noncitizens who had been improperly allowed to register to vote, state election officials got to work.
On Tuesday, the state sent a strongly worded rebuke to the federal government: Every single person on the list was a lawful citizen.
"As for the 185 individuals, our records indicate that they were citizens," Greg D. Ott, a deputy attorney general in Nevada, wrote, according to a copy of a letter sent to Department of Homeland Security officials obtained through open records requests.
"You have provided nothing of substance to suggest otherwise."Following the meeting, Ms. Vogt sent a clarifying email to Nevada officials. "I also wanted to be sure I clarified that we did not reduce the 15,903 to 185," she wrote. "We've manually reviewed some of the 15,903 and confirmed 185 are not U.S. Citizens."
Now, Nevada officials are saying even that 185 number is wrong. They also took issue with a letter D.H.S. sent them in early September, in which the agency reiterated its initial claims about nearly 16,000 noncitizens on the rolls and pressured state officials to review each case in a letter to Nevada officials in early September.

Several revalations in former AUSA Sheri Mecklenburg's motion to intervene in the Broadview Six case. (1) She retired today bc the US Attorney threatened to terminate her if she tried to intervene; (2) She accuses US of omitting facts that she says support her actions;
In this regard, the Court should be aware that, when notified (through counsel) that she intended to file a motion to intervene, the U.S. Attorney’s Office advised that, as a Department of Justice employee, Ms. Mecklenburg was not permitted to file anything on her behalf and could be disciplined or terminated if she did so. Ms. Mecklenburg then notified the U.S. Attorney’s Office that she was retiring, effective on September 24, in part so that she can address these issues on her own behalf.With respect to the claim that Ms. Mecklenburg improperly “excused” 9 Case: 1:25-cr-00693 Document #: 261 Filed: 09/24/26 Page 10 of 16 PageID #:2523 grand jurors who disagreed with the Government’s case, the United States did not point the Court to the Department of Justice, Office of Legal Education’s 2023 Federal Grand Jury Practice Manual (“GJM”). Specifically, Section 4.4 of the GJM instructs DOJ attorneys, in pertinent part, that “[a]ny jurors who indicate an interest that may interfere with a fair, impartial, and just decision concerning indictment should be asked on the record whether they can put aside any personal bias or prejudice and decide the matter fairly and objectively.”

ICE Shot a DoorDash Driver in the Back in Austin. Rather than getting him medical help, they carted him off to an ICE detention complex—and the bullet is still in his back. He could die as a result of the shot and ICE's denial of medical car, which makes it a homicide.

Within hours of a Feb. 28 missile attack that hit an Iranian school, some Pentagon personnel knew the US was responsible, according to officials involved in an internal investigation of the incident. That probe found what the officials now describe as a cascade of preventable failures.
Two Tomahawk missiles struck the Shajarah Tayyebeh Elementary School building and its grounds that Saturday, killing more than 150 people, including at least 123 children. The strikes devastated the two-story school, which was built on land that was part of a military compound in the southern Iranian town of Minab. In terms of child casualties, it's the deadliest American military targeting error of the 21st century.
