If the Framers of the Fourteenth Amendment meant to employ concepts drawn from the common law, but also they were under a general misapprehension as to how those concepts really worked? It's the misunderstanding that controls!

I've been on team "we're cooked" for a while. People are wired to believe the first facts (or "facts") they hear, and to get defensive if they're told they were mislead. Seen too many Facebook uncles say "well it could have been true" to be optimistic about this.
