Washington gives every low-income tenant a free lawyer — first state to do it. But default rates barely moved because you can't be assigned a lawyer in a case you never answered. Same statute, six counties: 20.9% to 48%. The difference is the building. New "Without Counsel" out today. 👇

Same Law, Different Building
The same eviction statute produces very different odds depending on which courthouse you walk into. Nobody is responsible for the gap.

The signs assume you already know which office is which. The clerk can't tell you what you need to know — that's the rule. The Latin isn't explained; it's announced. The exclusion doesn't start with a bad ruling. It starts in the lobby.

A judge can't advise you, can't coach you, can't name the defense you're missing. So when the other side has a lawyer and you don't, the bench watches you sink and stays silent — speaking would be "taking sides." We call that fair.

The Referee Who Can't Call the Foul
Judicial neutrality assumes two matched sides. When one has a lawyer and the other doesn't, the judge is forbidden to even the contest — and we call that fair.

More than 70% of debt collection cases end in default — the defendant never answers. That gets read as "they didn't care." I was one of them. It's not that we didn't care. It's a clock most people can't read, on a paper that assumes a lawyer.

A Wisconsin jury convicted Kevin Lychwick of murder today. I’m sure they got it right. I’m also sure that if he had a defense, he could not have presented it. The complexity of a criminal trial can make the right of self-representation theoretical. A right that can't be exercised isn't a right.
