Washington gives every low-income tenant a free lawyer — first state to do it. But default rates barely moved because you can't be assigned a lawyer in a case you never answered. Same statute, six counties: 20.9% to 48%. The difference is the building. New "Without Counsel" out today. 👇

Same Law, Different Building
The same eviction statute produces very different odds depending on which courthouse you walk into. Nobody is responsible for the gap.

Debra spent six months chasing documents the other side was ordered to produce. At the hearing, their attorney asked her two questions. She answered honestly. She lost. He wasn't allowed to ask. There was nobody in the room to say so.

American civil courts don't record the race, language, disability, or income of anyone who appears before them. A court that keeps no racial record hasn't stopped producing racial outcomes. It's stopped producing evidence of them. New Without Counsel out today.
withoutcounsel.substack.com
The Color of Unrepresentation
Courts process millions of people a year and write down almost nothing about who they are. The gap in the record is not an oversight.

A court can log every ramp, every elevator inspection, every interpreter hour, and put it in an annual report showing a clean accessibility record. There is no number for whether the proceeding worked. This week's Without Counsel:
withoutcounsel.substack.com
A Law Built for Stairs
The ADA made courthouses reachable for people with disabilities. It left the proceeding waiting inside exactly as it was.

In rural America, the problem isn't that legal help is expensive. It's that it often doesn't exist within reach. 52 US counties have zero lawyers. 182 more have just one or two. New Without Counsel, on justice rationed by geography.

The signs assume you already know which office is which. The clerk can't tell you what you need to know — that's the rule. The Latin isn't explained; it's announced. The exclusion doesn't start with a bad ruling. It starts in the lobby.

The Courthouse Architecture of Exclusion
The building, the Latin, the clerk's window — all of it says the same thing before a word is spoken.

A trained librarian. A doctorate. Twenty years finding anything in any system. She was stopped cold in court by four words: shall, may, should, can. Not the big words. The small ones. That's what a system built for lawyers does to everyone else.
withoutcounsel.substack.com
The Courts Built for Lawyers
The machinery of civil litigation was designed by lawyers, for lawyers. When you walk in without one, you're not just outmatched. You're operating a system that was never built for you to operate.

A librarian with a PhD was stopped cold in court — not by res judicata but by shall vs. may. That gap is the tell. Tomorrow's Without Counsel is about the system that produces it. 🧵

A judge can't advise you, can't coach you, can't name the defense you're missing. So when the other side has a lawyer and you don't, the bench watches you sink and stays silent — speaking would be "taking sides." We call that fair.
withoutcounsel.substack.com
The Referee Who Can't Call the Foul
Judicial neutrality assumes two matched sides. When one has a lawyer and the other doesn't, the judge is forbidden to even the contest — and we call that fair.

More than 70% of debt collection cases end in default — the defendant never answers. That gets read as "they didn't care." I was one of them. It's not that we didn't care. It's a clock most people can't read, on a paper that assumes a lawyer.

The Silence the System Calls a Choice
More than 70% of debt collection cases end in default. That silence isn't indifference — it's what a process built for lawyers does to everyone else.

A Wisconsin jury convicted Kevin Lychwick of murder today. I’m sure they got it right. I’m also sure that if he had a defense, he could not have presented it. The complexity of a criminal trial can make the right of self-representation theoretical. A right that can't be exercised isn't a right.

Debt collection is the largest category of civil litigation in America. Over 70% of cases end in default. The judge isn't deciding cases — the judge is processing them. The system works because almost nobody is fighting. Read this week's Without Counsel.

OECD priced the U.S. civil access-to-justice gap at $365B/year — and called it a floor. Add the categories they excluded and you cross half a trillion. A GAO study could put the figure on federal letterhead and force the cross-agency budget conversations that aren't happening.
