My favorite* thing is when someone tells me what Mormons believe about X. I'm sorry, sir or madame, but I've been Mormon since the 70s. I've attended church my whole life. I've blogged about Mormonism for nearly 20 years and written in Mormon Studies.

Seriously, office jobs are the best. And, except at the highest echelons, they leave plenty of time (and money!) to pursue hobbies for fun!

The Questionable Authority @questauthority.bsky.social · 6h
These are fair questions. I'll take 1 & 2 as a unit, since I don't think a race to the bottom is necessarily a bad thing. Right now, one of the problems with this Court is that the small size gives each justice way too much influence, and way too much of a sense of their own importance.

That brings up URLs that include the word "interfolio.")

Do you have a website the URL of which just absolutely refuses to stick in your brain? For me, it's Interfolio. For about two weeks of the year, I have to go to it at least a couple times a day, but I can never ever ever remember its name. (I find it by typing "180" in my address bar

And in a perfect world, his reforms are probably better than court-packing. But court-packing may be the best we can get, at least short-term.

That is, what expansion has going for it is that it's easy to understand, easy to see, relatively easy to do, and it has an underlying symbolic value. None of this is meant to undercut what @stevevladeck.bsky.social has said! Like I said, his post is careful and thoughtful.

Term limits + rotating nominations may well require a constitutional amendment (depending on whether "office" means being a Supreme Court Justice or just being any federal judge), which makes it a heavier lift. Also, there's historical precedent to it being a threat.

(4) This is the hardest one, imho. I actually don't think it is the best solution. But it's probably the most salient one. The general public can see that there are now 13 or 15 or whatever Justices; explaining jurisdiction-stripping is a harder ask, and you can't compare photos of the Court.
210
Sam Brunson @smbrnsn.bsky.social · 7h
I couldn't find any particular polling, in part, I suspect, because most non-lawyer Americans don't really think about lower courts a ton. But I don't know that distrust in SCOTUS automatically trickles down.
120
Sam Brunson @smbrnsn.bsky.social · 7h
(3) I don't think eroding confidence in SCOTUS is a feature. I think lack of trust in institutions--even institutions I don't love--is bad for human flourishing. That said, in my bubble, at least, people are actually fans of lower courts, which seem largely to be acting well in spite of SCOTUS.
110
Sam Brunson @smbrnsn.bsky.social · 7h
But I doubt there will be the political will to radically upend its historic size. Now maybe a change in 2029 will shift that calculus and destabilize it entirely. Idk. But if its approval rate bounces back, I strongly suspect we'll get a new equilibrium, rather than a race to the bottom.
110
Sam Brunson @smbrnsn.bsky.social · 7h
He's right that the 9-Justice SCOTUS has been stable for a LONG time. But also, its net popularity was positive for a long time. Its popularity has tanked in the last 5 years or so. If 2/3 of Americans approve SCOTUS, a handful of politicians will probably still rail against it.
Approval of SCOTUS above 60% in 2001, down to 34% in 2026

Sam Brunson @smbrnsn.bsky.social · 7h
So I'll give my gut reaction to Steve's questions, acknowledging that he's probably better positioned than I and I'd take his post really seriously. (1) and (2) The way we try to keep most political things in check: through politics and popularity.

Sam Brunson @smbrnsn.bsky.social · 7h
It's a really good piece, and definitely worth thinking about. I don't know that expanding the Court is the best, and it's certainly not the only, solution, but I think it's probably the most practicable solution.

but, like, the whole thing here is that AI can’t backfill subject matter expertise. that still has to come from a subject matter expert, and i feel like an awful lot of AI company and AI consultant pitches try to convince the potential buyer that they can cut the SME out, and they can’t.

I mean yes, going from 40,000 agents to more than 200,000 technically is more than tripling your number of agents.
Compass has grown quickly since its founding in 2012, but its $1.6 billion acquisition of Anywhere took it to the next level, more than tripling its U.S. agents from about 40,000 to more than 200,000.

Exactly. I wish someone would campaign on THAT. Just point out flatly in THEIR bullshit profit language. Immigration, DEI, etc., it's just plainly good for business, birth rates, lots of other stuff. The fact they are SO vehemently opposed to it is only explained by their underlying hatred.

The thing is, a significant portion of the military budget is salaries and benefits. And to the extent we can’t recruit enough people, well, immigrants also join the military!

I mean, to the extent the Right is freaking out about m birthrate, well, immigration is the solution to both labor shortages and having more children. Which means, taken together, it’s just racism all the way down.

If it wanted to, it would have done it already. I mean, you've further publicized a thing that was already publicized, so cool. But I doubt you can force the Bar to act. Exceptions: if you were a client and the attorney slept with you or stole your money, the Bar probably takes action.

Admittedly this isn't my area of expertise, but I *strongly* suspect that filing a complaint with the California Bar has, with like two exceptions, precisely the same legal effect as filing a complaint with the IRS: none. The Bar isn't obligated to move on it.
