In declining to provide interlocutory review of a denial of Section 230 protections to Meta, the Ninth Circuit misrepresented 230’s legislative history to conclude that 230 provides a defense to liability rather than immunity.

Once again, I'm sure many people will cheer this on because Meta is terrible and Zuck is terrible, but we should be very, very, very concerned when judges get to tell websites how various features should work. Especially when it's based on vibes.

9th Circuit found that “the regulation of like counts” is “content based”, and that a law regulating how they are conveyed to users is subject to strict scrutiny. NetChoice, LLC, v. Bonta 152 F.4th 1002 (9th Cir 2025) at 22–23. "Likes" are speech, dammit.

lol, this poor attorney. “Do you know what a quitclaim deed is?” “No.” “If I explain it, does that make sense?” “No.” “Okay, well if I tell you that this is a real thing that we use all the time, will you believe me?” “Gotta be real, that seems fake and made up.”
(MR. STEKETEE) As a historian, have you ever come in

contact with something called a quit claim deed?
A. No.
Q. Do you know what a quit claim deed is?
A. No.
If I told you that a quit claim deed was a deed from A to
B which relinquished whatever right A had in the property, but did not necessarily warrant that A had any right at all, would that have any meaning for you?
A. No.
l All right. Let me tell you, then, that there is such a thing as a quit claim deed, and that that is what it is; it's a deed from A to B in which A relinguishes whatever right he may have in a property without necessarily warranting that he has any right. All right? He may have none at all. Do you follow that?
A. I sell you a boat, whether I have one or not?
l. You sell me whatever right you have in the boat without
necessarily warranting to me you have any right at all, and there are many, many occasions when that kind of a deed is useful.
A.
Sounds pretty fraudulent to me.

And it's worth noting, yet again, the way I do every time this comes up, that overreaching laws purporting to cover an unpopular thing are never, EVER used against that unpopular thing in practice. They are used against marginalized people and disfavored speech.

Government Lawyers Say Trump Admin Can Use TikTok Again Because ‘Owned’ No Longer Means ‘Owned’
We spent a few years pointing out the ridiculousness of the whole "TikTok ban" moral panic, and the fact that all of the "concerns" magically melted away after Trump became president and then effectively gifted a controlling stake to some of his friends should raise some pretty big questions. However, most people seem to have accepted the new arrangement without much fuss — even though ByteDance still retains a 19.9% stake in the company, and users at no point…

The Science Is Not Settled: How Weak Evidence Is Fueling A National Push To Ban Social Media For Youth
As statehouses ramp up for 2026, we’re seeing a familiar and concerning trend of lawmakers rushing to regulate the internet based on shockingly shaky science. From the California State Assembly to the Massachusetts and Minnesota legislatures, a wave of bills is crashing against the digital lives of young people, with proponents of these measures framing social media access as a "public health epidemic," or a "mental health crisis," even though we have yet to see any of the settled science that those labels usually invoke.

If you want to overthrow Big Tech, you’ll need Section 230. The paradigm shift being built with the Open Social Web can put communities back in control of social media infrastructure, and finally end our dependency on enshittified corporate giants. But while these incumbents can overcome multimillion-dollar lawsuits, the small host revolution could be picked off one by one without the protections offered by 230.

JUSTICE ALITO: Well, we can affirm on any ground that would support the judgment and was raised below, and the good-faith exception qualifies on all those points. The Court didn't grant certiorari. We didn't brief it. The government did have a section of the Respondent's brief addressing the good-faith exception, but adhering to the Court's decision not to grant certiorari, we didn't respond in the reply brief except to ask for a remand. So -- JUSTICE ALITO: Well, that was your choice. MR. UNIKOWSKY: The Court did not grant certiorari.
