Well Actually, the reason to reject this premise is simply that OP insists on using C-3PO for his analogy when DATA IS RIGHT THERE Data is officially considered a sapient AI life form (The Measure Of A Man), desperately wants to make art, and admits *he can’t* because art requires human emotion.

Scenario: C3PO exists. Although he is a machine, he easily passes any known test of consciousness or personhood that doesn't include knowing in advance that he is a machine. He is capable of suffering and sadness.

Is it ethical to forbid him from making art?

If no, then the use of copyrighted art to train an Al can't be wrong in principle. You can only object that the model is not sufficiently conscious or not sufficiently a person.
