I have seen a couple people suggest in the Anthropic settlement that you should try to get the publisher’s share back from the publisher once it has been sent through one mechanism or another, and I feel it incumbent upon me to remind everyone.

The argument I would make would be that an infringement action is not a sale or a license, and so "royalty" is not analogous. And I would argue that in the absence of any explicit term in the contract, the parties should be bound by what is otherwise the industry standard: 50/50.

So if I were an author, and my contract did not contain an explicit split for infringement actions, I would absolutely dispute a publisher who claimed, based on royalty numbers, that I was only eligible for 12%.

@courtneymilan.com Correcting reply to you. I rec'd email from claims admin. Contrary to what the support person said, there is NO email verification of the allocation submission. We just keep a copy of the "success" page. Adj are made when 'all required submissions are received' and reviewed.

Also, I want to say this: just because the settlement administration THINKS something should be a certain way doesn't mean it HAS TO BE that way. You can always ask the special master for a ruling. The settlement administrator HAS to allow you to do that.

So, here's a weird thing about the Anthropic review emails. They are sending out different versions. I got one that asks me to request to see my claim summery. My husband got one that just gives him a link and a login code. Why the difference? And why do I have to ask to see mine?

Thinking about how, when designating a single class for this lawsuit, the parties told the judge that authors were generally working with publishers as partners and so there was unlikely to be significant disagreement over percentages. And I was like "lol. lmao."

Also, it appears that the settlement folks are having persistent errors with self-published works with more than one author. They can understand that a self-published work with one author = 100% payout to author.

I have sent the following questions via email to the settlement adminstration and have been told this will get it escalated to the appropriate person. I deleted some stuff in the beginning of the email identifying myself as a class member just b/c I'm not trying to make it a matter of record.
Thave a few questions about the settlement as it stands.
1. Is the Effective Date of the settlement August 20th, 2026?
Further explanation: The settlement documents provide this: "Effective Date" means one business day following the later of: (a) the date upon which the time expires for filing or noticing any appeal of the Final Judgment; (b) if there is an appeal or appeals (other than ones solely with respect to the Fee Award and/or service awards), the date of completion, in a manner that finally affirms and leaves in place the Final Judgment without any material modification, of all proceedings arising out of the appeals) (including, but not limited to, the expiration of all deadlines for motions for reconsideration or petitions for review and/or certiorari, all proceedings ordered on remand, and all proceedings arising out of any subsequent appeals) following decisions on remand); or (c) the date of final dismissal of any appeal or the final
dismissal of any proceeding on certiorari with respect to the Final Judgment. The time for appeals is now over. While there are appeals pending, those appeals explicitly state that they are solely with respect to the fee awards (and the parties appealing have no standing to appeal anything other than the fee awards). Thus, the only appeals are solely with respect to the fee award, and
a final judgment on the merits as to Anthropic has been left in place without material modification.
Please let me know if this is not the case, and if so, what the basis is for stating that the Effective Date is something other than August 20th.2. Has Anthropic now paid $1.05 billion into the settlement fund?
Per the settlement documents, Anthropic must make four installment payments to the settlement.
* $300,000,000: within five days of Preliminary Approval. This has already passed.
(i) $300,000,000: within five days of Final Approval. This has also already passed.
(iii) $450,000,000: within 12 months of Preliminary Approval (which has not passed) OR within thirty days of the later of Final Approval OR a Qualified
Financing Event. Anthropic raised $30 billion in Series G funding in February of 2026, and so the latter condition has been met. We are now more than 30 days after Final
Approval. (iv) $450,000,000: I am pretty sure that Anthropic's series H funding does NOT meet the requirement of a Qualified Financing Event because it was not
subsequent to Scheduled Payment 1, and so this amount has not yet been paid in.
By my calculations, Anthropic should have paid $1.05 billion into the Settlement Fund.
Has this happened?3. If the Effective Date is August 20th, 2026, should we expect the first payment, distributing the amount received to date from Anthropic, within 28 days of
the Effective Date, which would be on or around September 17, 2026?
The settlement documents state: Disbursement of Cash Payments from Settlement Fund. Within twenty-eight (28) days of the Effective Date, or such other subsequent date or dates as the Court may set or Class Counsel shall determine, the Settlement Administrator shall send Settlement Payments from the
Settlement Fund to Class Members.
Please let me know if there will be a different date than September 17, 2026, and if so, what that date will be.
4. Will the fees and costs allowed by the judge be removed in their entirety from that first payment, or will a pro rata portion be taken from each payment?
5. Do the settlement administrators plan to hold back a portion of the fees disputed on appeal from that first payment?
