Chancellor Frenk's statement is below. There are two problems with it: 1) Frenk's statement makes a mockery of an important principle of the rule of law 2) Frenk's statement shows a profound disregard for the nature of his job running an institution of higher education. I also see why he did it.

Why is Congress seeking to legislate Academic Freedom, to regulate the expression of faculty and students about Israel? This #hr4795 is a dangerous precedent. Academic freedom is not for Congress to legislate. Indeed, AF exists principally to protect our institutions from exactly this intrusion.

In the past, AHA executives have been quite content to let members pass popular resolutions against such events as the Iraq war, and to make official statements opposing events like Russia’s invasion of Ukraine. Regarding Palestine, though, they have decided that the AHA cannot take “institutional positions on an active geopolitical conflict,” lest the Trump administration take notice and find some way to revoke its congressional charter. Over the last 20 months or so, they have taken a series of what they have called “unusual steps” to quash every effort by the AHA membership to pass a resolution against the mass atrocities in Gaza, including vetoes of three separate popular resolutions acknowledging those atrocities as a genocide.

This is a body blow to the AHA and it was entirely avoidable. People can easily check my positionality in saying this but hiring a major firm to battle your own members into silence is a pyrrhic victory at best. At worst it is a mortal wound to the association.

This year's biggest con in the History discipline is the one where AHA paid consultants to represent their interests in DC only for the consultants to become Washington's lobby in our discipline. TRP advised AHA to align with Trump allies and dump the commitments of our discipline. And AHA agreed.

One harm the AHA @historians.org did in quashing Gaza resolutions is that its TRP-consultant-driven messaging has dramatically undermined the work of Middle East historians nationwide. When AHA communicates that our field is a political liability, our standing on campus/classrooms is at question.

Faculty cannot afford to be so naive. University counsel is an inherently political appointment and their politics are revealed through deference to federal directives, even as those directives fall in the courts due to the courageous efforts of @aaup.org et al. We must build power in every state.
"This summer's actions have proven me naive and now force me to recognize that our leadership bends to the winds of politics," Gonzalez said. "I, too, am culpable because I agreed to be a member of the Core Review Committee used to whitewash these governance changes. ... Today we can see that the outcome was already predetermined since our general counsel's narrow interpretation of SB 37 guaranteed certain narrow decisions."

This is super important. Historians troubled by AHA's bad politics respond in different ways. Till now I've been in the "hold the line" camp but refusing complicity, boycott, & building new orgs that reflect AHA's loss on the discipline's pulse are not only ethical, but interdependent, strategies.

That AHA is not in free-fall & heading towards collapse this AM says a while lot about professional historians. Let me quote Glissant out of context — “our history emerges at the edges of what we can tolerate”. The AHA survival would be an acknowledgement that we are willing to live with genocide.

AHA hired a lobbying firm with an extensive client list in Israel's occupations. And asked them how to squash advocacy by its own members working in/on the Middle East. It's bad. But It's clockable bc this is also what universities also do to crush dissent, discipline faculty in contested fields.

There are so many scholars who need the support of their colleagues at any moment. Who you stick your neck out for is noticed, especially when there are others with a better claim to that same support who you ignored.
