DOJ’s latest bellyflop in its voter file quest is the biggest yet #ELB
Justin here. About a year ago, I said that I thought somebody at DOJ involved with collecting state voter files might have committed federal crimes.  That view got substantially more backup today. A f...

This is a big deal. DC fed judge says that DOJ's pursuit (and use) of the state voter files is unlawful, on a bunch of different grounds. And effectively confirms that for the 18 states that submitted files willingly, whoever collected the files at DOJ Civil Rights committed federal crimes.

The takeaway from Bo French suggesting Asian students are “foreigners” and the tepid GOP response is that the Trump-era Republican Party is increasingly explicit about its belief that the only good immigrants, and the only real Americans, are white. (Gift link) www.theatlantic.com/ideas/2026/1...
The Afrikaner policy is illuminating, because it proves the catch-22 facing nonwhite immigrants: If you are poor, you are a moocher, and if you are gainfully employed, you are taking a job from a hardworking American. The only way to be a good immigrant is to be white and Christian.

Bo French, who is running for a seat on the Texas Railroad Commission, has taken this idea a step further, suggesting that the only way to be an American is to be white and Christian.

Hmmmm... www.politico.com/news/2026/10...
One prominent legal conservative said there is no doubt that, by hanging on, Thomas and Alito are taking a risk that their seats could be filled by a Democratic president.

“If [Republicans] lose the Senate, the chance of Thomas and Alito outlasting a Democrat presidency and a Democrat-controlled Senate, I think, is diminished,” said the conservative lawyer, who was granted anonymity to speak candidly about the sensitive issue of a justice’s retirement. “You're going to see, on the legal side, a lot of shoulda, woulda, coulda, and you're going to have the same sort of zeitgeist that happened around the Breyer situation,” the lawyer added, referring to pressure Democrats put on Justice Stephen Breyer to resign during President Joe Biden’s term.

Another attorney who is close to several conservative justices, granted anonymity to broach the sensitive topic, said he doubts either Thomas or Alito would make a quick exit following the midterms, in part because it could reinforce perceptions of the court as political.

“I don't think stepping down a day after the election or announcing you're going to retire effective on confirmation of your successor is something that they would be interested in doing,” the lawyer said.
