In a new court filing, SPLC provided evidence that the prosecution into the org came directly out of a letter that extremist groups sent to Stephen Miller complaining that they had been included in SPLC's Hate Map. emptywheel.net/2026/06/23/h...

The newspaper obtained a recording of the full hearing: www.youtube.com/watch?v=2xPQ... The judge issued a TRO less than a day after the school board sued. The newspaper's lawyer correctly cites binding Supreme Court precedent. Instead of pausing to read it, the judge imposes a prior restraint.

Court moves fast to block publication, slow to hear challenge
The New Brunswick Board of Education immediately demanded that the news outlet take down the video. On May 29, it took New Brunswick Today to court. That same day, a New Jersey court entered a temporary order against the paper requiring it to remove the footage. It also prohibited New Brunswick Today from even describing the video in writing or publishing other security videos it may receive.

But although it acted quickly to restrain the press, the court doesn’t appear as eager to hear New Brunswick Today’s First Amendment arguments. Instead, the paper must wait until another hearing in early July.

This delay is troubling, most importantly because the court’s order is wrong. It granted the prior restraint based on the school board’s argument that student and juvenile privacy laws justified removing the footage. Protecting minors’ privacy is important, and the laws the school board cited may appropriately require schools and courts to keep certain information confidential. But they simply don’t apply to journalists, and they can’t override the First Amendment.

Outrageously, the school board's demand letters raise the specter of *criminal* penalties, claiming it's disorderly conduct under New Jersey law to post the video. And then gave just hours' notice they would appear in court to have the video deleted from the internet.
