Fixing the upstream property design flaws requires curtailing property-like entitlements, expanding the digital commons, and recalibrating the remaining protections.

Antitrust hasn't just under-enforced against this. Its doctrine is built to tolerate it: monopoly profits as innovation incentive, permissive merger review, tolerance for market power spilling across markets.

Concentration undermines liberty, whether one subscribes to liberal or republican theories of liberty. Examples: app stores, search engines, and now LLMs.

Nikolas Guggenberger @nikenberger.bsky.social · 02/07/2026
Concentration forces complex relationships and creates fragility/single points of failure. Example for the latter: the Oct. 20, 2025, AWS outage took down huge swaths of the internet at once.

This captures network effects so efficiently that it leads to concentration. The problem: one of property's functions works too well.

Platforms enclose digital networks through five layers: contract, IP/trade secrets, privacy law, anti-hacking statutes, and intermediary liability shields. Same move as the English enclosure movement, just on meadows made of data and code.

Property's exclusion strategy is supposed to do three things at once: internalize externalities, create modularity, promote liberty. Usually these functions reinforce each other. In digital markets, they turn against each other.

"Employers" do not "add" jobs. Jobs are employment contracts entered into between employers and employees. Employment is not a benevolent gift bestowed on society by employers. Framing matters.
U.S. Job Market Pushes Past Shocks and Strains
Employers added 172,000 jobs in May, adding to a vigorous pace of hiring in recent months. But wage growth is not keeping up with higher prices and consumers remain pessimistic.

It is not surprising that over the first five years of GDPR, an RTBF penalty is issued once every nine days—a clear sign that the computing and data management communities have continued to oversimplify, misunderstand, and poorly implement RTBF. Our work is an attempt to remedy this disconnect.

Nikolas Guggenberger @nikenberger.bsky.social · 26/05/2026
“Isn’t it just deletion?” has been the computing community’s standard reaction to the RTBF’s requirements. While the end goal of RTBF is indeed the deletion of data, casting RTBF as just deletion is akin to saying that eating is just for nutrition.

For decades, the US called Europe's data restrictions thinly veiled protectionism. Then Washington passed sweeping data export bans. My piece in @lawfaremedia.org: regulatory actions reveal more about a country's self-assessment than any speech. Here, weakness.

The United States new push to restrict its data exports suggests the administration feels a diminished control over online platforms and infrastructure and a lack of confidence in technological dominance, writes @nikenberger.bsky.social.

Rather than demonstrating confidence, the protectionist turn is a sign of American vulnerability. It reveals deep-seated insecurities—if not an unintended admission that the United States is losing ground in a technological “great power competition.” papers.ssrn.com/sol3/papers....

It's hard to restore competition in a market that has already been crushed -- and I suspect the judge's cautious ruling requiring the very least from Google is not going to give competitors enough of a reason to jump back in to create search products. www.nytimes.com/2025/09/02/t...

This is bad. Very bad. So, even where courts find illegal monopolization, the remedies are weak. Just ask, if you were Google, would you do it all again?
