yeah I reveal it to them afterward. the point I try to get across is less about whether animus is present in masterpiece (I'm not convinced but I've had students present reasonable arguments that there is) and more about the Court's inconsistent holdings re: animus, racist intent, etc

I put up slides for my students of Trump’s rhetoric but replace references to Somalis and Muslims with references to Christians. They all seem to think it’s animus!

I am really struggling to understand the Bert Callais news as anything other than evidence of how the Big Lie ideology has fully taken root. It is no accident that he was at J6, just like it is no accident that the justice writing the opinion flew an upside-down flag that day

Yet again I remind everyone (as Elizabeth does in her very next tweet) that "foreigners are corrupting our pure blood with weakness & disease" is Fascism 101. Not some variant, not some metaphorically similar thing, not some echo -- the thing itself.

The Mirabelli per curium reveals that parental rights doctrine is just family values politics by another name. Conservative justices embrace a traditionalist-authoritarian view of the family and vote accordingly. I explain in the Harvard Journal of Law and Gender papers.ssrn.com/sol3/papers....

Folks have implored to assume good faith and engage in collegial ways. Spare me, friends. This is law office history in furtherance of stripping children who would otherwise be entitled to citizenship because the president doesn't like how they look. If this is acceptable to law profs, count me out.

If you accept that non-citizens have no right to due process, you are accepting that citizens have no right to due process. All the government has to do is claim that you are not a citizen; without due process you have no chance to prove the contrary.
