No it’s executive enforcement discretion made by executive policy. The immigration courts run by the executive branch have made a decision in enforcement discretion to call anyone crossing the border a criminal who doesn’t get “actual criminal prosecution” in real court unless it’s a violent crime.

It evolved to correct bad behavior in a social species without violence! If a chimp, a dog, an elephant, misbehaves, its group shames it to get it to act better.
