2. The following provisions of the Data (Use and Access) Act 2025 come into force on 30th

Four years to answer FOI requests! The ICO has issued an enforcement notice against Derby Council due to its ‘exceptional level of non-compliance’ with FOI law. Only 29% answered on time, some go back to 2022!
Derby City Council
The Information Commissioner has issued an Enforcement Notice to Derby City Council after evidence showed widespread and persistent delays in handling FOI requests. The council reported that only 29% of requests due between 1 January and 24 July 2026 were answered on time, while 59% remained overdue, with some outstanding requests dating back to 2022. The Commissioner found that these delays reflected systemic failures in the council’s FOI handling arrangements and amounted to an exceptional level of non-compliance with sections 1(1) and 10(1) of FOIA. The Notice requires the council to publish an action plan to address the causes of delay and to clear its backlog of overdue requests within six months.

This extract is from a recent Tribunal decision on Hampshire Police's apparently chaotic handling of an FOI request about a review of an old murder case - I'd suggest that 'a sequence of events which would reasonably have caused the Appellant concern' is something of an understatement
The chronology disclosed by the bundle reveals a sequence of events which would reasonably have caused the Appellant concern. The Constabulary initially informed him that it held no relevant information. It subsequently informed him that eighty-three boxes of relevant material had been identified and that a final report had been located following a review of fifteen boxes. Thereafter, during the Commissioner's investigation, the position evolved further, culminating in the conclusion that the document which had been located did not appear to be the final report after all.

Even if the IT measures under development help in due course, they will take a considerable time to implement, and without extra FOI funding the prognosis is not good: "We do not currently have a firm timeframe for any backlog recovery."
Identifying the most effective way of utilising this funding is our focus for the rest of this year, and we are building the business case for this now. We do not currently have a firm timeframe for any backlog recovery.

The ICO considered trying to tackle its FOI backlog by additional prioritisation, but decided not to, because while it would speed up some (more important) cases, the others would then take an extremely long time. Only a very small percentage of cases is currently prioritised.
I would note that, prior to receiving our CSR outcome, we had started work to explore different ways to prioritise and allocate cases in light of the pressures we face. However, in practice, these would have accelerated the closure of some cases and meant we took much longer than others. This is because the law requires us to make decisions unless the complainant withdraws or relatively narrow criteria apply, such as the complaint is frivolous or vexatious. As such, we are prioritising the tech investment we have been provided for this financial year and will revisit other options depending on the outcome of this.

The ICO is making clear publicly that it wasn't happy with the outcome of the last CSR spending review, and the impact of this on its ability to deal with increasing numbers of complaints
Unfortunately, despite bidding for more resource to recruit more staff at the last Comprehensive Spending Review (CSR), this was not successful. We continue to engage with government on this issue, but as a result, we currently anticipate allocation and wait times will continue to grow as approximately 400 excess cases a month are being added to our caseload. We did, however, receive funding to explore IT solutions that will support more efficient ways of working.

Interesting to see how, following the departure of John Edwards who did not want to make a public fuss about this, the ICO is taking a more proactive and assertive approach towards govt over its shortage of FOI funding at a time of rapidly increasing workload and backlog
We know our current operational performance is not what people expect, however, we have simply not received the resources required to tackle the rapid and unanticipated level of intake we have seen over the last 12 months. We will continue highlighting the impact of the funding levels we have been provided to government and parliament whenever we can. We continue to update our comms at regular intervals to keep the public accurately informed on our expected wait times.

I see from the letter (released thanks to @danneidle.bsky.social) that Jason Arday's lawyers Carter-Ruck told Times Higher Education that Arday objected to a THE journalist making FOI requests to institutions connected to him - on the grounds that he regarded this as 'aggressive'
We are instructed that your journalist has also sent several Freedom of Information requests to institutions connected with our client. While our client does not know if this is fuelled by your journalist or his anonymous source, our client has serious concerns about this 
aggressive approach, which is again dealt with towards the end of this letter.

The ICO's annual report out today also confirms how the under-resourced FOI side of the operation (funded directly by govt) is seriously struggling to cope with its substantially increasing caseload, which the ICO thinks is probably due to use of AI
At the end of 2025/26 our caseload was 3,505 (2024/25: 1,466), the highest level historically. The previous peak had been that associated with COVID-19 in 2021-22, when we finished the year with 2,227 cases in the caseload. This is a direct result of the significant rise in new cases we’ve received over the course of the last 12 months, which has also caused a significant increase in the time it takes to allocate a case to a case officer over the course of the year (currently 35 weeks in March 2026 compared with 16 weeks in 2025).

On a small but still concerning number of occasions, freedom of information requests and even threats of litigation from transparency campaigners and special interest groups were required before contract information was published or the scale of the problem with transparency during the pandemic was publicly acknowledged.
