4th Cir. holds that shackling a pregnant inmate during labor and immediately post-partum, without penological justification, violates the Eighth Amendment AND this is such common sense prison officials should have known. No QI. www.ca4.uscourts.gov/opinions/247...
As discussed above, we find that the conduct of Witherspoon, Brodie, Williams, Lynch and Ragano constitutes “potential deliberate indifference,” id. at 448, such that summary judgment was inappropriate. So, the remaining issue is whether their conduct was clearly constitutionally deficient such that Thorpe applies. We hold that it was. Collapsing the inquiries is appropriate because the risk was obvious and Witherspoon and the four officers were “on notice of the full volley of harms their [shackling] practices created.” Thorpe, 37 F.4th at 936. As in Pfaller, 55 F.4th at 446, it is a matter of common sense that you should not shackle a pregnant offender while they are in active labor. Giving birth carries risks for both the pregnant offender and baby under any circumstances; between 2019 and 2023, North Carolina reported 29.8 pregnancy-related deaths per 100,000 live births, ranking 34th in the United States for maternal mortality. BREAKING: DC Circuit upholds district court order blocking IRS from sharing tax return information with ICE. storage.courtlistener.com/recap/gov.us...
Before: MILLETT, PILLARD and WILKINS, Circuit Judges.
Opinion for the Court filed by Circuit Judge PILLARD.
PILLARD, Circuit Judge:
After the Watergate scandal exposed executive branch abuses of U.S. taxpayers' information to harass the Administration's enemies, Congress enacted a prohibition against the Internal Revenue Service (IRS) sharing tax return information with any other federal agency unless the requesting agency meets stringent conditions. In response to requests from Immigration and Customs Enforcement (ICE), in the summer of 2025, the IRS developed a specialized procedure for disclosing return information. The procedure failed to ensure that ICE's requests complied with statutory requirements. The IRS nonetheless began using the procedure to disclose tens of thousands of records.
Several groups sued. The IRS had turned over more than 47,000 records by the time the district court stayed the IRS from using the new procedure and preliminarily enjoined further disclosures without notice to the court. We affirm.

BREAKING: Judge Boasberg denies DOJ's motion to vacate the court's prior decisions quashing the subpoenas issued to the Federal Reserve, accusing DOJ of looking for "a creative way to clear its loss from the books." storage.courtlistener.com/recap/gov.us...
UNITED STATES DISTRICT COURT FOR THE DISTRICT OF COLUMBIA
In re Grand Jury Subpoenas Nos.
BOARD OF GOVERNORS OF THE FEDERAL RESERVE SYSTEM,
Petitioner,
V.
UNITED STATES OF AMERICA,
Respondent.
Miscellaneous Action No. 26-12 (JEB)
MEMORANDUM OPINION
This controversy began when the Government issued two grand-jury subpoenas to the
Federal Reserve Board of Governors. One demanded records about renovations to Board
buildings, while the other sought information on related testimony that the Fed's then-Chair,
Jerome Powell, had delivered before Congress. This Court found that the subpoenas were meant
to harass Powell and to pressure him to truckle to the President's policy preferences. It also
concluded that the Government had no good-faith basis to believe that Powell was guilty of any
crime other than displeasing the President and that the Government's justifications were mere
pretexts. The Court therefore quashed the subpoenas.
Instead of appealing, the Government closed its investigation. It now proposes a creative
way to clear its loss from the books: it asks this Court to vacate the prior Opinion and Order
because any appeal challenging the Court's decision would be dismissed as moot. The Court
will deny its Motion.

Rhode Island district judge Mary Mcelroy has quashed the subpoena from the DOJ seeking to access the medical records of trans youth. She enjoined DOJ as well. She calls DOJ "untrustworthy" and DOJ misrepresented and withheld information from the court. storage.courtlistener.com/recap/gov.us...
The image is a legal document titled "Memorandum and Order" from the **United States District Court for the District of Rhode Island**, presided over by Judge Mary S. McElroy.
The text focuses on a case involving an administrative subpoena to **Rhode Island Hospital** (C.A. No. 1:26-mc-0007-MSM-AEM). A significant portion of the second paragraph is highlighted in yellow, which states:
> "DOJ has proven unworthy of this trust at every point in this case. It has misrepresented and withheld information to both this Court and the United States District Court for the Northern District of Texas (the “Texas court”). It did so in an obvious effort to shield it’s recent investigative tactics—previously rejected by every other court to review them—from this Court’s review, in favor of a distant forum that DOJ deems friendly to its political positions."
>
A footnote at the bottom of the page cites remarks from **Judge Reed O'Connor** regarding "forum shopping" by the Department of Justice.

MONTANA SUPREME COURT: “Transgender discrimination is, by its very nature, sex discrimination,” and is subject to strict scrutiny under the Montana Constitution.
Transgender discrimination is, by its very nature, sex discrimination. Discrimination based on sex is expressly prohibited under Montana’s unique Nondiscrimination Clause––“[n]either the state nor any person, firm, corporation, or institution shall discriminate on account of . . . sex . . . .” Thus, Article II, Section 4 is
unequivocal in its intolerance for discrimination based on sex. Because sex discrimination involves a fundamental right under Article II, the appropriate level of judicial review is strict scrutiny. Snetsinger, ¶ 17.

¶28 Being transgender is also a suspect class under the Equal Protection Clause of
Article II, Section 4,––“[n]o person shall be denied equal protection of the law.”
