It took signing up for two different stock trackers (paying ~$15 total for premium service on both) and being stuck in line approximately 50 times (seriously, Best Buy is THE WORST), but I am proud to announce our long national nightmare is over. I have secured a PS5 Pro.

Original Skeet: I agreed to sell my 10 year old nephew my PS5 a few months ago, figuring I could roll that money into buying myself a PS5 Pro.

A brilliant idea in June. A disaster when he finally puts together enough money in October and the PS5 Pro is now rarer than hen’s teeth.

Reskeet: This little S.O.B. Just offered to rent the PS5 back to me when GTA VI comes out next month.

I admire the entrepreneurial spirit, but damn that is ice cold.

This prediction re: AI assisted contracts is right on the target, and I think anyone who regularly drafts contracts ought to see it, because it suggests to me that most of us already have the technical expertise for what’s coming. From @hoffprof.bsky.social profhoffman.substack.com/p/the-declin...

But vague standards— "reasonable wear and tear," "sudden and accidental," "in the landlord's reasonable judgment"—are harder to attack because the fight becomes about applying the standard to facts the consumer (and thus the AI) doesn't fully have. So, if firms wanted to walk a self-protective line against AI bots, they might themselves try to avoid bright line rules and move toward standards.
My guess is the equilibrium looks more like bifurcation.
Firms will make the grounds for denial or exclusion in consumer contracts standard-like
—discretionary, fact-intensive, textually slippery, hard for an Al to attack on the face of the contract. And they will make the procedural preconditions more rule-like, more unforgiving, and more numerous. That is, we'd see a growth in strict notice windows, documentation requirements, insurance cooperation clauses, appraisal-process requirements, etc. I am skeptical there will be a net effect on litigation filing rates.
