Oboy. So, remember how I published a book with @neonhemlock.bsky.social in April called The Mystery of the Bitten Peach? I went ahead and registered the copyright. As you might imagine, the main reason I bothered to do that was *because* of the AI companies stealing copyrighted material.

There are already many other similar lawsuits, some of them class actions. More are undoubtedly on the way. Unfortunately, litigation is a very slow process.

It will be interesting how they handle paying the money to a literary agent who is not a rightsholder. The only way they can legitimately do it is if the author gives the agent's address as their own.

Just want to add that this problem happens with rights-reverted books with multiple co-authors. With the additional problem that the publishers are making claims in error.

Difficult to see how the agents are involved at all if the settlement pays the authors directly. The only way is for Wiley to claim 0% for authors and distribute the money themselves.

Right! There are other class action lawsuits similar to the Bartz Anthropic case and they all require that the book has a contract registered with the US Copyright Office. At least one also requires that the book have an ISBN.

I'd add to make sure that any contract you sign does specify the minimum sales number or amount of royalties per time period. Authors who reverted their rights will get twice as much as those who didn't in the Anthropic Settlement.

Yes, I agree with that. There's no evidence that Anthropic downloaded (I meant downloaded above, not uploaded) audio files at all and they aren't covered by this settlement.

It seems to me it's not necessarily the publisher that originated the book if it's been reverted and resold to a new publisher. If the guidance on timing of a reversion is correct, then it would be the publisher at the time the book was uploaded by Anthropic.

Another argument is that the infringement just began when Anthropic downloaded a book, but it continued as long as they were actively making files available to the public through torrenting and arguably right up until they deleted the files.

Okay. That's a question I should have asked. But it still could be worth making a claim that the work had reverted to see if the Special Master agrees. Nowhere in their FAQ do they make date distinctions except for when the work was copyrighted. There's enough uncertainty to make a claim.
