What you're saying is, the antitrust exemptions in the NBA, MLB, NFL, etc. are allowed as a result of the collective bargaining process, whereas the PCSA seeks a similar exemption by circumventing the collective bargaining process. Is that correct?

Generally, yes. When we talk specifically about labor markets, all of the restraints that we see in labor markets of our professional sports leagues—the salary cap, the draft, the limits on player movement, every single one of them—to the extent that they're exempt from antitrust law, are the products of good-faith collective bargaining between the management group and the players group, and exist in a collective bargaining agreement that was reached through good-faith bargaining.

What is being proposed with the Protect College Sports Act is to establish the exact same types of labor restraints, specifically a salary cap, specifically a number of years of eligibility to compete in college sports, and specifically limits on transfers, but not to do so in collective bargaining where there are representatives in the room, on behalf of employer and employee, but rather through a legislative bill, which seems to be negotiated by a number of different constituent groups, none of which is a representative of the players in any meaningful sense, and absolutely none of which have been chosen and selected by the players as a union representative.

In a world where outright bigotry and discrimination are not just accepted but celebrated by some, people will not willingly subject themselves to it. The number of queer people has not and will not change, but the number of people willing to be out will if society is filled with hate or not.

One thing I think about on the anniversary of 10/7 is how, personally, my mourning was mixed with dread over what was to come. And how angry I was, even in the moment, that Israel’s response was so certainly going to descend into something morally reprehensible, that I couldn’t simply mourn.

On some level the trans kids in sports debate is about keeping locker rooms “normal - white, heterosexual and cisgender - because if a young trans girl is fine in a locker room then young queer kids are too. And that’s not what sports are supposed to support some believe.

And all of these sports, the men's pro leagues on down, are hopefully going to realize one day that gatekeeping this way isn't just morally wrong (it is), but is actively setting money on fire. The NHL's extremely awkward dalliance with Heated Rivalry is a great example of this.
