I worry that there's a communication breakdown when "mistake" and "crime" are treated as a dichotomy. A kid who gets involved in gang violence has made mistakes, that does not change the gravity of the situation if he shoots someone.

Got it, that's a completely accurate assessment. I'd suggest that this applies to parasocial outrage cycles writ large, but it's worthwhile to be reminded of the left's susceptibility specifically.

I don’t know if a targeted harrassment campaign against Lindsay Ellis instigated at least in part by right-wing discord sowers is a helpful point of comparison. Like, what lesson are we supposed to take from that ordeal, and how should we be applying that lesson here?

Horseshoe Theory is a theory in the same sense that gravity is, but I would still caution against taking a deranged right-winger's "I was a Member of the Left" statement at face value. It's such a frequently-used rhetorical strategy as to be cliché.

Donald Trump goes off-script frequently, and he has increasingly let these kinds of comments slip during prepared remarks. This wasn't a stumble, it was an aside. And even if he misread the prompter, why did the audience cheer while he smirked at the prospect?

Listen to the cheering at the comment of "let them take out Los Angeles". He may be flubbing prepared remarks, but he is pretty clearly doing so by ad-libbing with a riff about his (and his audience's) hatred of Californian cities. We don't need to sanewash a demented rant because it was off-script.

He did though, which is why McConnell refused to hold the vote for confirmation. Under your theory of governance, without a partisan majority in the Senate, the President could he preempted from seating any appointees at all. That's not advice and consent, it's Constitutional subversion

Or, in the case of denying a quorum, NO business is conducted, and everything grinds to a halt. I don’t know why Obama allowed Republicans to invent a pocket veto privilege from whole cloth, but that was a deeply toxic precedent to set for pur government.

Sure, but I don’t get your point. The procedure is relevant. The Senate was free to hold the hearing and vote the nominee down. The law does not allow them to leave the business of government in a vacuum through inaction. Even cloture/fillibuster obstruction is based on the Senate actually convening

This is true, but the parallel that comes to mind is crypto boosters who called out the structural problems in global banking. The observation is accurate, but the proposed solution doesn’t fix those problems while introducing a new suite of its own problems.

It is pretty clearly both? Whether you frame it as a power or a duty, though, it was waived by the refusal to hold a hearing. A precedent where the Senate can grind the Executive Branch to a halt without even convening for a vote is utterly dysfunctional, and should never have even been humored.

If the Senate will not even hold the confirmation hearing and vote down the appointee, they refuse their Constitutional duty and the President continues to have the duty to appoint the officer.

It's not a clause, it's a legal theory. Article 2, Section 2 says: :He... shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States"

The Senate had waived its Constitutional privilege to advise and consent by refusing to hold a hearing. Obama should have put her on the bench immediately and neutralized the issue instead of engaging in performative bipartisanship that kept SCOTUS a motivator for GOP voters.

Sure, but that's the structural bias of the law. Large legal resources and the structure of penalties makes it much harder to go after the very wealthy like that. We still should, but that requires us to think about the mechanism, especially if it's a rationalization against wealth taxation.

Deleted the earlier post because, in trying to express legality and edge cases of journalistic merit, "good faith" was the wrong word choice - publicly identifying an anonymous assault victim is a flagrant breach of journalistic ethics, even in false accusation cases like the 2014 UVA allegations.

But since I have the author's ear, I'm curious how you think the US could appropriate Elon Musk's assets. Even with a criminal conviction, is there any statutory basis to sieze wealth on that scale? I'm not aware of any such precedent.
