I agree with the Court’s interpretation of the Federal In-
secticide, Fungicide, and Rodenticide Act and its applica-
tion of our preemption precedents. I therefore join its opin-
ion in full. I write separately to call attention to some of the
underlying constitutional infirmities in the Act.
First, the Act likely exceeds Congress’s authority under
the Commerce Clause, which authorizes Congress to regu-
late “Commerce . . . among the several States.” Art. I, §8,
cl. 3. This power allows Congress to regulate “selling, buy-
ing, and bartering” across state lines. United States v.
Lopez, 514 U. S. 549, 585 (1995) (THOMAS, J., concurring).
It does not allow Congress to regulate “agriculture” or
“manufacturing,” activities entirely “separate” from “com-
merce.”

Trump and Hegseth are asking for a record $1.5 trillion defense budget. Roughly half of defense spending goes to private contractors that routinely price-gouge the government. Meanwhile, the Pentagon has failed EIGHT straight audits. The military industrial complex is cheering right now.

A win! Thank you for always making your voices heard. The House passed a DHS funding bill by voice vote this afternoon, ending a 75-day shutdown the longest agency shutdown in U.S. history. The GOP caved. The bill funds DHS but includes no money for ICE or Customs and Border Protection.

Aside from who started it, states like CA and VA putting a counter-gerrymander up to a referendum, where people are told and can make a decision on the context for why it's being done, has vastly more democratic legitimacy than state legislators rushing it through because they got bullied by POTUS.

One indication of congressional atrophy is that people turn to SCOTUS for the thing we should but don't get from Congress: an actual public debate on an important policy issue. Which of course isn't supposed to be a legislative debate, but we've stopped having any actual legislative debates.
