Last week, the Supreme Court tightened the mechanisms of compassionate release in the federal system. In separate decisions, the justices ruled that compassionate release can't be used to revisit doubts about a conviction, or to reduce a sentence considered excessive by today’s penalties.

The court unanimously affirmed late last month that the California state constitution gives most people accused of crimes a right to pretrial release, and that judges cannot make that right meaningless by setting bail at an amount that the person can prove is financially impossible for them to meet.

We found over 70,000 cases referred to law enforcement over allegations of substance use during pregnancy — and that’s a significant undercount. In many cases, the referrals began with false positive results from flawed drug tests — sometimes triggered by the women’s prescribed medications.
