don’t see how fukuyama’s entire premise survives hegel saying that a human subject in a state—not in nature—is recognized not from their “desire of the other’s desire,” pride, or “thymos” but from their obeying the universal and actual will: the law. See Encyclopedia III § 432.

problem i have with death penalty is how the sheer act of simply having it as a sentencing option fills an entire state legal machinery with bloodlust. it’s not enough for the state to take its time. it desperately *must* end a person’s—even a heinous one’s—life.

There is, of course, a legitimate question as to whether Ko-jève's interpretation of Hegel, presented here, is really Hegel as he understood himself, or whether it contains an admixture of ideas that are properly "Kojèvian." Kojève does take certain elements of Hegel's teaching, such as the struggle for recognition and the end of history, and make them the centerpiece of that teaching in a way that Hegel himself may not have done. While uncovering the original Hegel is an important task for the purposes of the "present argument," we are interested not in Hegel per se but in Hegel-as-interpreted-by-Kojève, or perhaps a new, synthetic philosopher named Hegel-Kojève, In subsequent references to Hegel, we will actually be referring to Hegel-Kojève, and we will be more interested in the ideas themselves than in the philosophers who originally articulated them.

Abstract: Recent developments in administrative law limit Congress’s ability to confer regulatory discretion on its administrative agents. Commentators have tended to view these developments as undermining progressive social policy, which has operated throughout the twenty-first century primarily through the administrative state. But Congress can respond by avoiding reliance on regulatory discretion in the first place. The new judicial doctrine does not constrain the use or acquisition of public resources. Thus, Congress has incentives to rely on a different set of tools: Pigouvian instruments (taxes and subsidies), redistribution, public infrastructure, and social control of investment. Despite recent progressive coding of regulatory bureaucracy, this alternative toolkit might well result in more egalitarian consequences. In many ways, the regulatory state was the instrument of a neoliberal mode of governance that offloaded ownership and control of resources onto private parties. The ultimate victim of the Roberts Court’s war on the regulatory state might be neoliberalism.
