WE WON!! Incredibly proud to be working on this case with such an incredible team. This is an important win against federal overreach, and a warning to states like Tennessee that knowingly turn over our sensitive data to agencies and officials who are up to no good.

Once again, the Supreme Court prioritizes imaginary harms done to Trump by not allowing him to indulge in his conspiracy theories, as opposed to the very real harm done to citizens who may lose the ability to vote in this case.

Couldn’t agree more with @nikobowie.bsky.social here. The whole “eh, real reform is too hard politically/ legally / whatever” argument is just giving up without even trying. Weak sauce.

SCOTUS allows Trump minions to use notoriously error-riddled database to target the entirely fake “scourge” of noncitizen voting *while acknowledging* that US citizens will be caught up in this mess AND harmed. SCOTUS reform MUST be at the top of the list for pro-democracy candidates for office.

@scsjofficial.bsky.social, by the way, is the organization that Justice Earls founded in 2007. Justice Allison Riggs, herself the subject of a very tight race in 2024 that her opponent tried to steal after the fact, took over as ED once Justice Earls joined the Court.

Just a coda on this -- the switch in control of the Court discussed in the article undid a lower court ruling in CSI v. Moore, a felony disenfranchisement case @protectdemocracy.org, @scsjofficial.bsky.social, and others brought that would have restored voting rights for 55,000+ North Carolinians.

This is on par with how important the Supreme Court elections in Wisconsin were over the last few years. Justice Earls is incredible, but she needs all the help we can give -- this is one of the most expensive races of any kind in NC history (and far and away the most expensive judicial race).

As usual, Justice Jackson hits the nail right on the head (excerpt from p. 9 n. 5): www.supremecourt.gov/opinions/25p...
Under this approach, the Executive can intentionally act in harmful
ways that violate the law, decline to defend the legal merits of its unlawful actions, and nevertheless put challengers on the defensive (by thwarting injunctions on the basis of alleged flaws with the form of plaintiffs’
legal claims), thereby extending its unlawful activity for as long as possible. See, e.g., CASA, 606 U. S., at 839 (considering only threshold procedural questions while the underlying merits issues festered). This is a
noxious litigation strategy that should be a red flag for courts. It forestalls resolution of the merits, prolongs unjustified harms, and wounds
public confidence in the judiciary’s ability to award actual relief for meritorious challenges. Furthermore, if sowing chaos is the Government’s
ultimate goal, as it is here (see Part IV, infra), the effectiveness of judicial
review is substantially undercut when the Court shunts all consideration
of the lawfulness of the Government’s conduct at the stay stage and
greenlights significant harms in the interim

Re: SCOTUS USPS / mail voting ruling Voting rights cases have become more and more stymied by bulls*** jurisdictional and technical games that government lawyers and their allied judges play. Standing doctrine has essentially become just a way to avoid decisions on the merits, nothing more.

Great story in the LA Times over the weekend on the Trump Administration's potential plans to interfere in the midterms and, more importantly, what groups like @protectdemocracy.org, @democracyforward.org and others are doing to prepare and fight back. www.latimes.com/politics/sto...
It is designed to match what Trump’s opponents see as his three-part “interference playbook” — to “deceive” voters before the election, “disrupt” the vote itself and “deny” any unfavorable results after, said Justin Vail of Protect Democracy, a prominent litigant against the administration.

“The threats are real,” Vail said, “but the preparation is larger and more coordinated than ever before.”
