This list of the limitations of the Emergency Planning and Community Right to Know Act (EPCRA) is 💯. I once advised companies on EPCRA reporting compliance, and what I learned was that there's a *lot* that doesn't get meaningfully reported and publicly disclosed.
LIMITS OF THE EMERGENCY PLANNING AND COMMUNITY RIGHT-TO-KNOW ACT

Academic literature has long noted that the EPCRA only partially delivers on its promise of community protection, pointing out structural limitations that include:9

Limited accessibility and usability of
data. Publicly available EPCRA data
collection and reporting systems are
often inconsistent, highly technical, and
difficult to understand.

Resource constraints at the local level.
Local Emergency Planning Committees
(LEPCs), responsible for coordinating
emergency response planning, frequently
lack adequate financial and technical
resources and are staffed by volunteers,
limiting their ability to support
community oversight.

Incomplete emissions accounting.
Mechanisms and calculations used to
measure toxic releases are not
standardized, and omit fugitive
emissions, accidents, short‑term peaks,
and cumulative multi‑facility exposures
that residents actually experience.10

Lack of accountability for noncompliance.
There are no consequences
for industries that fail to file reports on
time.

Restricted access to critical
information. Certain information may be
restricted by states due to homeland
security concerns, requiring formal
requests, delaying access, or limiting
transparency altogether.

Gaps in chemical reporting requirements.
Not all harmful chemicals are on the
required reporting list (e.g., many PFAS
actually present in LIB components [e.g.,
polyvinylidene fluoride PVDF binders,
fluorinated salts like LiPF6] are not on the
TRI list, and the reporting thresholds are
set high [100 lbs/year]).11

Aggregation instead of specificity. Not
all states require that facilities report
exact chemicals, their quantities, and
their locations, but rather allow aggregate
volumes based on hazard category,
obscuring meaningful risk information. 12

If your position is that next-gen industries can and should be built responsibly to avoid worsening the harms of a legacy of extractive development in places abandoned by oil/gas/coal/etc., you should take a keen interest in Lithium Valley. You get at most one shot at getting these things right.

In February 2025, the California State University system announced a $17 million contract with OpenAI to provide ChatGPT Edu to all faculty, staff, and students on its 22 CSU campuses as part of a larger “AI-Empowered University” initiative. This is the largest contract ever established between a university system and an artificial intelligence company.

Despite the name, ChatGPT Edu is not educational technology. It is a general-purpose chatbot that is not designed, trained, or optimized for education. Beyond its privacy and security features, ChatGPT Edu is identical to the free online version of ChatGPT. ChatGPT Edu does not use reliable peer-reviewed sources to answer students' questions and is indifferent to whether its answers are correct. Experts argue that ChatGPT Edu is harmful to academic working conditions, diminishes the quality of teaching and learning, introduces new forms of discrimination, and is dangerous to students' mental health.

Recent polling shows that CSU students share these concerns, with the majority of students expressing that they are worried about the negative impacts of generative AI on human creativity and the environment.

How do we rectify the imbalance between green energy minerals and water? We met closer to home with Dr. James J. A. Blair, Associate Professor of Anthropology at Cal Poly Pomona, who has done research and collaboration on lithium mining in both the Salton Sea and Chile. In a recent paper he and his co-authors advocate for a framework of community engagement and consultation. Inevitable environmental degradation can be addressed through the implementation of community benefits agreements to establish a just water-energy transition.
