Extrait de la décision de justice :

4. L'OFII fait valoir que la décision de blocage est l'effet d'un incident technique.
Toutefois, il n'apporte aucun élément de nature à le justifier alors que le blocage est intervenu de manière concomitante à un échange de commentaires entre l'OFII et l'association Utopia 56, dans lequel cette dernière formulait des critiques quant à la mise en œuvre par l'OFII de sa mission de service public. Il ressort par ailleurs des pièces du dossier que plusieurs autres comptes ont été bloqués par l'OFII et que son directeur général a indiqué devant des journalistes qu'il « assumait » procéder au blocage des comptes s'avérant critiques de l'action de son établissement public. Le compte de l'association requérante n'a, au demeurant, été débloqué que près de trois mois après que la requête de cette dernière ne soit communiquée à l'OFII. Par suite, le blocage en litige doit être regardée comme ne résultant pas, comme l'OFII le fait valoir, d'un incident technique mais d'une décision prise délibérément par le directeur général l'OFII.
5. Si les propos tenus par l'association Utopia 56 à l'origine du blocage de son compte par l'OFII ont été formulés en des termes polémiques, ces propos étaient néanmoins dénués de caractère diffamatoire ou injurieux et n'ont pas excédé les limites du droit à la libre critique de l'action de la puissance publique dans une société démocratique. Par conséquent, l'association requérante est fondée à soutenir qu'en bloquant son accès au compte X de l'OFII, le directeur général de cet établissement a méconnu les dispositions et stipulations précitées.
6. Il résulte de ce qui précède que l'association Utopia 56 est fondée à demander
l'annulation de la décision révélée du directeur général de l'OFII du 17 janvier 2024, sans qu'il soit besoin de se prononcer sur les autres moyens de la requête.

Dans la nuit, nous avons appris le décès d'au moins une personne dans la Manche. Elle était déjà décédée quand les secours sont arrivés pour venir en aide à l'embarcation. En deux jours, deux personnes sont mortes. Sur le littoral nord, on ne veut jamais être demain.
