jd vance just tweeted this "What process is due" the fucking constitution
Consider that Joe Biden allowed approximately 20 million illegal aliens into our country. This placed extraordinary burdens on our country--our schools, hospitals, housing, and other essential services were overwhelmed. On top of that, many of these illegal aliens committed violent crimes, or facilitated fentanyl and sex trafficking. That is the situation we inherited.

The American people elected the Trump administration to solve this problem. The President has successfully stopped the inflow of illegal aliens, and now we must deport the people who came here illegally.

To say the administration must observe "due process" is to beg the question: what process is due is a function of our resources, the public interest, the status of the accused, the proposed punishment, and so many other factors. To put it in concrete terms, imposing the death penalty on an American citizen requires more legal process than deporting an illegal alien to their country of origin.

When the media and the far left obsess over an MS-13 gang member and demand that he be returned to the United States for a *third* deportation hearing, what they're really saying is they want the vast majority of illegal aliens to stay here permanently.

Here's a useful test: ask the people weeping over the lack of due process what precisely they propose for dealing with Biden's millions and millions of illegals. And with reasonable resource and administrative judge constraints, does their solution allow us to deport at least a few million people per year?

If the answer is no, they've given their game away. They don't want border security. They don't want us to deport the people who've come into our country illegally. They want to accomplish through fake legal process what they failed to accomplish politically:

The ratification of Biden's illegal migrant invasion.

President Trump and I will not stand fori t.

Judge Boasberg writes: "The Constitution does not tolerate willful disobedience of judicial orders—especially by officials of a coordinate branch who have sworn an oath to uphold it." Anything less would make “a solemn mockery” of “the constitution itself.” storage.courtlistener.com/recap/gov.us...
One might nonetheless ask how this inquiry into compliance is able to proceed at all
given that the Supreme Court vacated the TRO after the events in question. That Court’s later
determination that the TRO suffered from a legal defect, however, does not excuse the
Government’s violation. Instead, it is a foundational legal precept that every judicial order “must
be obeyed” — no matter how “erroneous” it “may be” — until a court reverses it. Walker v. City
of Birmingham, 388 U.S. 307, 314 (1967). If a party chooses to disobey the order — rather than
wait for it to be reversed through the judicial process — such disobedience is punishable as
contempt, notwithstanding any later-revealed deficiencies in the order. See id. at 314, 320. That
foundational “rule of law” answers not just how this compliance inquiry can proceed, but why it
must. See id. at 320. The rule “reflects a belief that in the fair administration of justice no man
can be judge in his own case,” no matter how “exalted his station” or “righteous his motives.”
Id. at 320–21.
The Constitution does not tolerate willful disobedience of judicial orders — especially by
officials of a coordinate branch who have sworn an oath to uphold it. To permit such officials to
freely “annul the judgments of the courts of the United States” would not just “destroy the rights
acquired under those judgments”; it would make “a solemn mockery” of “the constitution itself.”
United States v. Peters, 9 U.S. (5 Cranch) 115, 136 (1809) (Marshall, C.J.). “So fatal a result
must be deprecated by all.” Id.

🚨Here is Judge Boasberg's opinion finding that he has probable cause that the government in CRIMINAL contempt for defying his orders on March 15: storage.courtlistener.com/recap/gov.us...
As this Opinion will detail, the Court ultimately determines that the Government’s
actions on that day demonstrate a willful disregard for its Order, sufficient for the Court to
conclude that probable cause exists to find the Government in criminal contempt. The Court
does not reach such conclusion lightly or hastily; indeed, it has given Defendants ample
opportunity to rectify or explain their actions. None of their responses has been satisfactory

I'm exhausted just contemplating the coming fight over the meaning of "facilitate." DOJ has previously argued that in immigration law, "facilitating" "does not require [the US to take] any affirmative steps." By DOJ's reading, it means *permitting* the person to return, not enabling it.
