It won't get nearly as much attention, but I'll also highlight that the first 2/3 of the article is a legal critique of the viability line, arguing that it lacks a normative foundation. I'm grateful to @convergepitt.bsky.social for connecting scholars across disciplines so work like this can exist!

There are lots of other figures and findings in the article, which I hope you check out! We break out the results by demographic and discuss how it would impact voter turnout (spoiler alert: all three ballots increase turnout).

We also found strong voter understanding of what each referenda would protect, with 76.5% of people receiving the no-limit ballot reporting that it would protect 3rd tri abortion. Even when limiting to those who said the no-limit ballot would protect 3rd tri abortion, 62.7% said they would vote yes.

We found strong support for all 3 options (67% support for the viability limit; 68% for the viability limit w health exception; and 66% for no limit). This 2-point difference was not statistically significant & suggests that a viability limit is not a decisive driver of support for referenda.

Co-authored w two med school professors, Dana Loll & Tamar Krishnamurti, we surveyed 2,000 people who were randomly assigned to see 1 of 3 abortion rights ballot measures: (1) strict viability limit (2) viability limit w health exception & (3) no limit. Sample was balanced for age, sex & pol party.

My favorite thing abt this paper has always been the appendices! The 1st appendix has every state's abortion definition, which is color coded, & shows changes side-by-side. The 2nd appendix does the same for health-related ban exceptions. I refer to these constantly bc I want the statutory language!

Greer Donley @greerdonley.bsky.social · 15/09/2026
We also did a deep dive into the ban exceptions, finding much smaller changes. Though 7 states have altered their bans' health exceptions, the changes have been more modest overall (and almost all in response to litigation).

By contrast, only 7 abortion-supportive states have changed their definition of abortion since Dobbs. Only one changed its exclusions, and it removed them. No need for exclusions when abortion is protected! You can see in the 2nd chart that "abortion" means very different things in different states.

Almost all the antiabortion states that changed their abortion definition (14/16) added what we coined 'definitional exclusions.' Instead of broadening health exceptions in bans (more on that later) they are trying to define out care that intersects w abortion (eg, ectopic pregnancy & miscarriage).

The fact that antiabortion legislatures are changing their definitions to try to exclude ectopic pregnancy means that they know this is a serious problem. Yet, unfortunately, the changed laws haven't fixed the risk aversion. Medicine is not always clear & doctors are scared.

MEMORANDUM OPINION
Since 2000, the U.S. Food and Drug Administration has determined that mifepristone is a safe and effective medication for early pregnancy termination. Each time the FDA has reviewed mifepristone, it has reaffirmed its safety and efficacy.1 But the FDA has consistently imposed certain prescribing and dispensing restrictions, known as Risk Evaluation and Mitigation Strategies (“REMS”), because it concluded such restrictions were necessary to ensure that the drug’s benefits outweighed its risks. The 2023 REMS imposed by the FDA on mifepristone require that (1) prescribing pharmacies be specially certified, (2) prescribing clinicians be specially certified, and (3) prescribers and patients sign a form acknowledging the treatment and
its risks. Dkt. 78-7 at 389–92. Abortion providers in Virginia, Kansas, and Montana brought this case to challenge the 2023 REMS as excessively restrictive, unwarranted, and inconsistent with
the requirements of the Federal Food, Drug, and Cosmetic Act of 1938. The issue before this....

CONCLUSION
The REMS modifications are arbitrary and capricious. The FDA has steadfastly found, over the past quarter century, that mifepristone is a safe and effective medication. The explanation for the REMS and ETASUs imposed by the FDA in 2023 does not identify the risk alleviated by the restrictions. Nor does the FDA explain how, without these restrictions, prescribing the drug becomes an intolerable risk which would require withdrawal of the drug from the market. The FDA failed to reasonably justify its 2023 REMS modification decision, disregarding substantial contrary evidence from the medical community and comparative regulatory data, and inadequately addressing the burdens imposed on providers and patients. While Plaintiffs’ claim that the FDA exceeded its statutory authority fails, the Agency’s failure to consider relevant evidence and provide a reasoned explanation renders the 2023 REMS modification arbitrary and capricious in violation of the APA and the Fifth Amendment.
