Many people are calling the US-EU trade deal the worst in U.S. history: * No commitment from the EU to pay fair prices for U.S. pharma * No commitment from the EU to treat U.S. tech and digital service providers fairly * 15% tax on Americans who buy from the EU will shrink US exports

The U.S. statement boils down to "The WTO rule that import surcharges may only be used to combat a threat to monetary reserves does not apply to the United States." I find their lack of reading comprehension disturbing.

DOJ arguments re: Sec 122 tariffs 1. Tariffs must follow GATT rules 2. Tariffs must be based on current acct balance in violation of GATT rules 3. The current acct deficit ($69B lower than last year) is getting bigger 4. POTUS has unreviewable authority to determine whether we have payments problems

The new nonreciprocal trade agreement between the US & Guatemala contains the phrase "Guatemala shall" 105 times, and "United States shall" 7 times. The general US tariff will be 10%, subject to some exceptions. Guatemala's tariff on the US as of 2024 was less than 1%. Not very reciprocal, is it?

Section 122 is often put forward as a possible replacement if the IEEPA tariffs are struck down, but what if the conditions for imposing tariffs under Section 122 have not been met? Check out the argument on this point by @freetradebryan.bsky.social.
