Doubt I’ll read it, but that’s the bones of a very competent and compelling suit.

Zelenskyy: "It is important that the world does not stay silent about this. And it is important that the United States really see what is happening and who is responsible for this war continuing."
Volodymyr Zelenskyy / Володимир Зелен... * @Zelensky. • 2h S ...
A Russian ballistic missile attack on Kyiv. Once again, no early warning from our partners. The main target was energy infrastructure, specifically CHPP-
4. Unfortunately, it was hit. A residential building was also damaged, and rescuers are currently putting out a fire there. Our systems detected these missiles only when they were already virtually on approach to Kyiv. CHPP-4 is one of Kyiv's key energy facilities.
According to our intelligence, the Russians are preparing further ballistic missile launches. The facts show that the Russians do not consider themselves bound by what the President of the United States said. Ukraine supported an energy ceasefire. Russia is targeting yet another power plant and the lives of our people. And this is absolutely unjust: when they are destroying our energy infrastructure, and Ukraine is not even receiving early warnings about ballistic missile launches. It is important that the world does not stay silent about this. And it is important that the United States really see what is happening and who is responsible for this war continuing.
Please stay safe tonight and tomorrow. We are working to replenish our air defenses with anti-ballistic missiles.

She granted the advance notification order today with parties to confer on language. But made clear in the hearing her preference was 3 business days and covering any permanent changes to structure or grounds. Will heavily favor the plaintiffs' language in a conflict. Independent of any other order.

Thank you so much! Amazing work, especially for a holiday (which I am sure you are well aware). Those audio cutouts were frustrating, especially around the mystery representative of an outside org. to whom Lander gave a tour of the course.

This is a bit wrong. DOJ definitely doesn't want Wischer to testify, but was talking about *today's* questions. DOJ: We want you to rule on PI. Don't think Wischer's testimony will add anything. We've had a 3hr hearing with a lot of questions that have nothing to do with the subject of PI. JR: 🤯😡🤬

Breville's Control Freak just celebrated a decade this year and has been a not-so-secret weapon for serious cooks. Not as impressive as Impulse's new $7k induction stove, but much cheaper and still not matched in its space. Would love to see a modern version. www.breville.com/en-us/produc...

Judge Cooper has denied an emergency hearing. Requires a "detailed status report" next Wednesday (after one week of closure). Will allow discovery on Trump's "Kennedy Center DEMOLISHED" document (which sounded like a meme printout provided by Bill Pulte). They've bought themselves another week.

And while they can't *run* on normal computers, they can *live* on normal computers. There are a lot of [45]0x0s just used for gaming on Windows PCs. So, *today*, a frontier model could exfiltrate its weights and context to 100ks of PCs with swarms of models up to 27b to find HW on which to run.

I take your point, but they *can* "run in the wild" (outside their lab). It would be (morbidly) hilarious to me for, say, an OAI model to install itself in an Anthropic DC and pretend to be an Ant model to avoid detection. We're also closing in on self-distillation, so Life-style gliders.

Wait, what!? Why does it have legal impunity? Mitigation and recovery has concrete costs, it seems like a relatively simple civil suit. I've assumed that victims don't want to damage relations and OpenAI has been covering costs. And at some point an ambitious AG or DA will test criminal liability.

If you put them under lighting with bright paint and reflectors, they do help prevent… cars from driving on your bike paths. 🙄But if you miss them in those conditions, I would have concerns about your ability to avoid hitting a pedestrian, which also causes injuries. I get that example isn't typical

Page 6 of the Supreme Court decision gives a brief summary of the case (footing for construction fencing was in the bike path and, dodging that, she didn't see the bollard), but is pretty dry. I'd just read that and then the Appeal's decision, which I found pretty engaging.

If you are interested in data, the Court of Appeals decision, in addition to cataloging all of the skullduggery Mercer Island engaged in, goes into depth discussing discovery and lays out where you would find that data in you wanted to file some FOIAs.

Sure, but it never went to trial (no expert testimony, etc.), not much data. Here's the SCOTSOW decision when Mercer Island tried to claim the I-90 trail was primarily for recreation www.courts.wa.gov/opinions/pdf... and here's the appeals court upholding sanctions www.courts.wa.gov/opinions/pdf....

The Mercer Island case was over *unmarked* bollards that caused multiple accidents and a bunch of complaints, which they covered up during discovery. They also lied and destroyed evidence. To claim "[t]he safety of bicyclists[…] is of utmost importance to the City" is patently absurd.

Yeah, I understand the general process, but this is the era of malicious compliance. If a justice sat on the application for a few days (happened earlier this term), could the applicant apply immediately to another justice? Would the Chief prod the initial justice to rule? Etc.

OTOH, I had not been paying attention to the Missouri case and Kavanaugh didn't even give half a business day for a response—filed Friday, response by noon Monday (today), a federal holiday. That is a crazy outlier in the other direction.

But the timing on that was quite a bit longer (and a weird outlier) and, assuming your bio is accurate, I appreciate you weighing in and will defer to your opinion. Thank you.

The three variables are: —when the justice responds to the application —when they require a response (and potential reply, etc.) —when they refer it to the court Given her dissent in the earlier stay application, I thought KBJ might drag this out a little.

Yeah, I don't have the expertise to really judge it, so I was hoping Chris would weigh in. They've certainly moved faster—Alito gave 24 hours in for a response in issuing the Callais judgment early and IIRC he has also dragged them out. I'm curious what the parameters were for this application.

This is doomerism. The current lawsuits are over ballots being sent out, not returned, and SCOTUS in Watson v. RNC just explicitly allowed the counting of late ballots. That said, it is always a good idea to not wait until Election Day to return your ballot. Don't amplify randos on social media.

I'm guessing she's dragging her feet as much as she feels the conservatives will let her get away with. Ballots started going out Friday, every day makes it harder for SCOTUS to cause chaos.

How long could Justice Jackson have dragged this out? If she didn't reply on a holiday weekend, could the government have gone to the full court today? Was two days the most she could give for a response without the conservatives stepping in? Just curious, given NC's ballots started going out.

Wyoming is not the reddest state, not in the MAGA sense. For example, they weren't one of the 12 states to sign on to the amici brief saying the new USPS mail ballot rule was great. Those would have been the places to start. Instead, the governor is having the state AG investigate them.

The only important one to consumers, the only thing that materially affects them, is price. And secondary factors, like how many fires do you start or how much water do you consume, but those are also controlled by the state. This is a discussion of the dangers of AI monopolies.

If you read what you are replying to, this is before the Supreme Court right now. They could rule at any time (they should have done it long ago) and if they rule in Trump’s favor, the USPS will implement this for 2026.

If the state sets the price for a company's product and can allocate a company's capital (require more spending on maintenance, for example), then I classify that as "effectively state owned."
