For Alito to now suggest — with apparent sincerity — that Section 2 must be neutered to protect the rights of white voters in Louisiana from a remedial Black majority district is like arguing that a homeowner must tear down their fence because the fence discriminates against a burglar’s right of access. The analogy would be laughable if its real-world consequences were not so monstrous.

Boards are stewards of tangible assets (eg endowments) AND intangible ones (eg reputation). The two are bound: no solvent institution = no mission fulfilled. When they truly conflict, mission governs. That’s why boards can *lawfully* wind down institutions that can’t serve theirs.​​​​​​​​​​​​​​​​

Is a university board’s duty to protect the institution or its mission? Per AGB, it’s the mission. The “duty of obedience” requires boards ensure their institution operates to further its stated purposes—and to amend the mission itself when necessary. Mission is the North Star. 1/2

I think the first breakdown should be by control, i.e. isolating for-profit entities. When I personally looked at these figures ~5 years ago, I found that the *numbers* of tenured and tenure-track faculty had increased over time, but their *proportion* had fallen relative to NTT “VITAL” faculty.

That’s a really good point! We’ve been designing a curriculum of communication strategy, crisis leadership, foundational knowledge (tenure, academic freedom, university finances), storytelling… but I think we’re missing an oppty if we don’t engage faculty with these modes/platforms. Thank you!🙏
