These statements do little to prevent further withdrawals. The ASP needs to amend its Universality Plan of Action (there since 2007) to counter the trend of exits. A dedicated effort is required now. “Dialogue” needs to translate to action. 📍 asp.icc-cpi.int/sessions/pla...

This was the only right decision for the Bureau to make. If the ICC President, the OTP Deputies and several CSOs cannot access NY due to US sanctions, nothing in the Statute prevented a move to The Hague (Art 112(6)) This should be standard practice until the US lifts sanctions.

It all depends on what the Bureau proposes as a process. There are many options from a “close” election between the deputies to a full fleshed process. In all cases, there is nothing preventing a short timeline and a Special or resumed session for election. Looks likely right now we will wait a lot

2/2 The same threshold should be applied to all judicial elections. Under attack, with cases reaching trial stage and needing leadership after 2 years of limbo, the OTP needs a permanent Prosecutor immediately. All well to have able Deputies, but the RS mandates one Principal.

1/2 Two months after the removal of the ICC Prosecutor and more than one month after the Bureau asked the ASP Sec for options for the necessary election, no news what comes next. In comparison, Res.6 (2004) mandates a judge election date *within* one month when a vacancy arises.

Ps: some said Trump’s call for ICC withdrawals was not followed by many - here is one and many more might come (Colombia, Ecuador, El Salvador, etc). Any and all withdrawal are bad news for the Court and any reliable international accountability system.

3/3 Withdrawals have a direct impact in the cooperation and budget regimes of the Court on top of denying access to justice to victims, in this case, potentially related to environmental crimes. Vanuatu’s proposal for ecocide together with Fiji and Samoa will now be weakened.

2/3 Leaves the Court with 119 members by Sept 2027. The AP group with 18 members (the lowest group) and a question: what steps did the ASP President take since knowing about the intention to leave? Universality is an “objective” of the Bureau. It needs to be taken seriously.

Ireland ratifies all Rome Statute amendments available, including on Art 124. This makes Ireland of the few States Parties that have done so (less than 30). An example how to support the Court meaningfully. All States Parties should follow.

Acting prosecutor? Of course it is important the OTP is led comprehensively during a time its chief is vacant. But that a Deputy becomes “acting”, is, as far as the legal framework is concerned, not envisioned. Should it? Sure, but that requires Statute and RoPE amendments.

2/2 The ASP, and its President in particular, have a role to protect, strengthen and provide the Court with political cover to function. I’m afraid gone are the days of quiet diplomacy. Value-based diplomacy when loud, works. One quick tactic? Abandon all ICC NY based meetings.

1/2 The assault by the US on the ICC was always going to include targeting the whole institution. They went for OTP and President already. What matters is what preparation and political coordination has taken place to avert and then respond.

Several useful points in this interview with Prof Mégret. Realising “sovereignty” as a power of the 125 (soon to be 120) States Parties to support, enable and strengthen the Court is a tangible way to counteract the US and others that want a docile or weak intl criminal system ⤵️

7/7 Quick institutional reading: a Court pre-empting the cut. The request/approval gap fell from €13.3m (2024) and €10.7m (2025) to €0.7m (2026). Now it asks +1% and self-cuts €5.9m. The organs the ASP itself owns, SASP and IOM, are the ones asking for real money.

6/7 ASP Secretariat: +22.3%, to €4.1m. Similar story to the IOM. Huge mandate, little capacity. The Sec is reformed. Interesting: a new post to manage induction of new reps into the ASP. A good call to begin building institutional knowledge for governance.

5/7 IOM, the largest relative rise: +25.3% to €1.46m. With 6 staff (~25 cases/investigator) and inspections dormant since 2018, the budget asks the ASP to fund more capacity. Given its recent history, new P-5 Ethics Office, Gender Focal Point, Ombuds are proposed.

4/7 OTP: €63.9m, no new posts, 60 positions redeployed. The structural story: the Palestine and Ukraine Unified Teams move from the Prosecutor's own programme (2500) to the Deputy Prosecutors'. Palestine continues in 2027, no details on expense and investment.

3/7 Resilience is now the operating model. Drivers: US sanctions, in absentia convictions in Russia, cyberattacks. Response: "non-US nexus" IT (€887k), a 24/7 non-US cyber provider (€900k), a Treasury post to manage banks' sanctions exposure and a €1.28m Security Blueprint.

1/2 Last time some past ASP Presidents wrote together, the Independent Expert Review process took place. Now they are rightly asking for commitment of States Parties to protect the Court. A lot of what they ask depends on leadership of the Bureau, led by the President.

It’s a good sign the Bureau is moving on the 4th ICC Prosecutor election process. The current situation whereas 2 Deputies are “acting-up” should not be normalised. The OTP requires leadership to move on, rebuild trust and deliver justice for victims.

The Bureau also asked the NY and Hague WG to “discuss” if ASP25 should take place in New York. Several States Parties and others (many) have complained. This is a no brainer. Leave the US, go The Hague. A practical way to oppose US sanctions and visa restrictions.

That the Bureau wants a “robust” process is a good thing. What that looks in practice is important as this election will be followed closely, seeking an individual to lead the OTP that is *tangibly* of high moral character and competence. A job that also comes with US sanctions

The options paper will take into consideration the “lessons learnt” report from the 3rd election. It was a less than ideal process that undid the original plans from 2018/2020. The Bureau should also reflect on the 1 and 2 election, both not exactly transparent either.

Electing the 4th ICC Prosecutor is an urgent task of the Bureau as it fixes the nomination window and manages the process. The Bureau recognised this and promised an options paper by their next mtg (next month). The regular Dec mtg should be used to launch the process.

2/2 Many ways the ASP and its Bureau can avert withdrawals and oppose US sanctions. Two, for example: 1- all ASP business should be in The Hague, not New York. 2- take universality seriously, strategically, bringing the public narrative of accountability to a wider public.

1/2 While I support this statement 100%, it is incomplete as it does not address any policy recommendation specifically for the ASP. The ASP is the governing body of the ICC. There is no individual State or regional action without an ASP corresponding decision.

It seems some diplomats believe the location cannot be moved because it was mentioned in the ASP24 omnibus resolution. This is not true. The ASP Rules allow the Bureau to decide on location. It happened during Covid. And it’s in line with Art112(6). NY is best bc less non-diplomats attend.

It doesn’t have to meet in NY at all. If the reason is to assure all State Party delegations are in attendance for the election of 6 new judges, the ICC Trust Fund to assist travel of diplomats is available and has been used in the past. Leaving the US will send the right signal.

First ever ICC President under sanction, this time from a supposedly close ally of Japan, the top contributor to the Court. At this stage, whatever the ASP President and, still, 125 parties do next, will mark how serious States are in protecting the Court. Time to act.

On 15 August, the beloved Flavia Lattanzi, former ICTR&ICTY judge and Professor of international law, passed away. I still haven’t read any obituaries, but the personal memories people (including myself) are sharing are so heartwarming. She was a caring and principled human being.
