Avoiding the Supreme Court’s Religious Charter-School Trap: Governance Change for the New Legal Era
Forty-six states and the District of Columbia permit charter schools to open, and 33 states plus D.C. allow independently governed charter schools that the Supreme Court may soon declare to be non-state actors not bound by constitutional obligations. This could create major legal tensions, as states may be unable to exclude religious charter schools from public funding while also losing the ability to enforce constitutional protections against discrimination and government establishment of religion. The issue stems from the Supreme Court’s increasing willingness to require states to fund religious institutions on equal terms with secular ones, potentially opening the door to publicly funded religious charter schools. States with independently governed charters could face heightened constitutional risk, while those with district-governed charter systems may be better positioned to preserve charter schools’ public character and oversight. Amazing paragraph. Amazing story.
We spoke for several hours, a conversation in which Mr. Girn referenced Julius Caesar, Plato, the founding fathers, environmentalism, Bismarckian Germany and Taylor Swift. As we talked, it became clear that the rise and fall of Guidepost was an only-in-America story of a charismatic founder who’s more confident than capable, and of the deep-pocketed investors who enabled him. But instead of an app that failed or a tech platform that went sideways, to the detriment of some customers, this time the casualties were children.

2d Cir. holds that public classroom wall and door decorations are speech pursuant to official duties as gov't employees, and so it did not violate the First Amendment rights of teachers for school to order them to take down their Pride flags. ww3.ca2.uscourts.gov/decisions/OP...
In short: the teachers cannot state a First Amendment viewpoint discrimination claim against the District, the Board of Education, or individual District officials because the pride flags and stickers they displayed on their classroom walls and doors were speech that “owes its existence” to their “professional responsibilities.”  Garcetti, 547 U.S. at 421.  As a result, their First Amendment rights were not violated when they were ordered to remove them.

31 August 1926 | A Polish Jew, Dawid Wiśnia, was born in Sochaczew. Deported to Auschwitz in December 1942 from the ghetto in Nowy Dwór Mazowiecki. No. 83526 In 1944 he escaped from a transport to Dachau. He joined the US Army & emigrated to the US. He became a cantor. He passed away in 2021.
