Dit volgt uit eerdere rechtspraak (o.a. Bosnië v Servië). Mbt Gaza heeft Internationaal Gerechtshof (ICJ) expliciet een urgent risico vastgesteld op genocidair geweld tegen Palestijnse volk en maatregelen opgelegd (die door Israël geschonden worden). Israël werd door over hele lijn tegengesproken.

... even pijnlijk, helaas, is de duiding van @vrtnws.be. De intentionele component van genocide is inderdaad essentieel (zie: x.com/Dimitri_VdM/...). Maar Israëls claim enkel Hamas aan te vallen is daarbij niet materieel. Intentie volgt, in internationaal recht, uit (genocidair) gedragspatroon.

There is some ambiguity in these few lines on conquest / annexation / use of force but it resonates with his EJIL:Talk point that occupation is not jus ad bellum problem (contra AO). The piece indeed seems to indicate (mistakenly, I think) that short of statehood, this is SD (not use of force) issue

Thanks for sharing. I continue to be confused by Marko's indication that prohibition use of force hinges on Palestinian statehood. ICJ seems quite explicit that occupation - even bracketing question of statehood - "involves, by its very nature, a continued use of force in foreign territory" (AO 253)

Dat is waar het gemak van de Europese lethargie en hypocrisie in dit conflict zijn limiet bereikt: eenmaal alle grenzen op geweld zonder tegenspraak of reactie zijn overschreden, is het onmogelijk het internationaal recht nog in te roepen als de razernij je eigen deur bereikt.

Maar wat is het punt van juridische analyse? Natuurlijk is het plan illegaal. Zelfs dit dreigen is illegaal. Is het nog zinvol macht aan recht te toetsen als zelfs de schijn het recht te volgen verdwenen is? Eenmaal recht(ers) de vijand van populaire wil zijn? Een donkere vraag.

Het plan past in context van Israëlische bezetting en geweld die Palestijns grondgebied heeft versplinterd, sociale cohesie gebroken, natural resources gestolen en elk pad naar zelf-beschikking versperd. Het is niet hyperbolisch om het hier over puur koloniale logica te hebben.

Trump's plan om Palestijnen te verdrijven volgt een koloniale logica van etnische zuivering. Het is een schending van het Palestijnse recht op zelfbeschikking en Conventie van Genève (IV). De gedwongen verplaatsing waar Trump toe oproept is een misdaad tegen de menselijkheid.

Misschien zijn dit holle woorden? Belangrijk: onder international recht is ook dreiging met geweld verboden, precies om oorlogsescalatie te vermijden. Wat Trump ziet als onderhandelingsstrategie - zie ook Groenland en Panama - is precies de escalatie die VN Verdrag verbiedt.
