17 Unionisation and decriminalisation of sex work
Conference notes that:
A significant number of sex workers undertaking performance work are LGBT+ workers, 
including trans and non-binary performers, reflecting both the diversity of the creative 
industries and the economic marginalisation faced by LGBT+ people.
Due to the criminalisation of sex work and the poor terms and conditions in other 
connected work, LGBT+ sex workers are particularly vulnerable to exploitation, unsafe 
working environments, harassment and non-payment. Trans and migrant LGBT+ workers 
face heightened risks of discrimination, profiling and barriers to reporting abuse.
Conference believes that:
Sexualised labour does not remove or diminish an employer’s duty of care.
LGBT+ workers in all sectors have the right to work safely, free from discrimination, with 
access to union protection and clear contractual standards.
Conference calls on the TUC LGBT+ Committee to:
i. support affiliated unions to organise with and recruit LGBT+ sex workers
ii. promote union contracts and minimum health and safety standards in relevant 
spaces
iii. campaign for the full decriminalisation of sex work as a matter of LGBT+ 
workplace safety and trade union equality.

Criminalisation creates exploitative conditions. The law prevents sex workers from accessing the labour rights & protections necessary for us to organise to change our working conditions-incl. the right to organise for recognition & challenge the misclassification of our labour.

In Belgium, where s_x work was decriminalised in 2022, labour rights were expanded to fit s_x workers. This included enshrining a workers' right to refusal, as well as access to sickness pay, maternity leave and unemployment benefits.

There is no such thing as "supporting" S/x workers while punishing buyers. Punishing buyers typically means policing them. Policing buyers means surveilling workers. Period. You cannot separate the two. Police surveillance IS policing. So policing buyers IS policing workers.

Important points made in this article about mainstream media and culture profiting off stereotypical depictions of sex workers or the aesthetics of sex work while sex workers are being erased from the internet.

The Nordic model doesn't work for one simple reason: It doesn't trust sex workers. The premise of the Nordic model is that sex workers cannot be reliable narrators of their own lives. It reinforces the idea that sex workers don't know what will keep them safe.

The criminalisation of street sex work doesn’t help sex workers - fines, cautions and ASBOs (all of which are still being given to sex workers around the country) simply trap them in sex work, in more poverty and sometimes with a criminal record. This is why we need decriminalisation.

Policing interventions are not an appropriate response to street-based sex work. People sex working on the street need financial support, secure housing, access to healthcare, and whatever other services or support will help them to meet their needs.

This has led to women being less willing to report violence from clients to the police, and less willing to access support services. The English Collective of Prostitutes and Dr Binta Sultan explain the obvious harms being caused by heavy-handed policing of sex work in Enfield.

A @mdmfrance.bsky.social report published a few years after the implementation of the Nordic model in France found that it had led to sex workers experiencing worse poverty, more violence, and worse health outcomes. Migrant sex workers in particular still felt targeted and harassed by the police.

This week sex workers went to the French Senate to present a proposed bill to decriminalise sex work, developed by sex workers themselves. France has now had the disastrous Nordic model (client criminalisation) for 10 years. The fight for decrim goes on! 💪

One respondent to our survey said they went into sex work because “Due to my health conditions, I can’t keep a regular full-time job. Benefits were not enough to survive”. It seems that this government is not only content with this situation, it’s comfortable with making it worse. (4/x)

This is a horrendous failure of the state to adequately support disabled people and those with long-term ill health. Disabled people are already much more likely to live in poverty than non-disabled people. This is the context in which this government is making more cuts to social security. (3/x)

People in the UK are going into sex work to support themselves financially because they can’t continue in another form of work because of their disability/illness, because benefits don’t give them enough money to live on, or because they can’t get access to benefits in the first place. (2/x)
